Probation and Community Sentencing

Probation and community sentencing are closely linked to the offence that the defendant has committed. The courts will try and avoid a custodial sentence where possible as this could have a detrimental impact on the offender. The court will always seek to ensure that justice is upheld, but instead of a prison sentence, the court can hand down a community sentencing as an alternative option to prison. If you are an offender and have served a prison sentence of more than 12 months, you will automatically on your release be put under the supervision of the National Probation Service (NPS).

The Criminal Justice Act 2003 also bought into law two new offences: Community Order and Suspended Sentence Order. Both of these have an impact on probation and community sentencing. The court will usually order the offender to perform one or more ‘requirements’ as part of their sentence within the Suspended Sentence Order or the Community Order. These will usually be managed by the offender’s probation officer that have a range of leaflet giving details of each requirement.

What Does Probation Mean?

Anyone that has served a prison sentence of 12 months or more will automatically on their release be assigned a probation officer. The justice system seeks to rehabilitate all offenders - the probation services is a key component in that rehabilitation. The court and the wider judicial system does not want to simply release offenders back into the community without any help and support. You can read more about the NPS on their website. The remit of the NPS is to:

  • Prevent an offender from committing more crimes
  • Enforce the offender’s community sentence conditions
  • Resolve any issues that resulting in the offender committing their crime in the first place

If you are given probation it is important that you comply with all the rules that have been set out by the court. The judicial system insists that any conditions it places on your probation are followed to the letter. Remember you must never:

  • Attend a meeting with your probation officer drunk or under the influence of alcohol
  • Miss a meeting with your probation officer
  • Use threatening behaviour

If you break the conditions of your probation you will be sent back to court. The court will then make a decision whether you should be sent back to prison. It is your legal right to make a complaint about the probation service handling your case. All appeals should be made to the NPS office handling your case. If you are still not satisfied your complaint has been dealt with, you can contact the Prisons and Probation Ombudsman that will investigate your complaint as they have a legal responsibility to investigate all complaints and appeals about sentencing decisions.

What is Community Sentencing?

Community sentencing has proven to be effective as it can ensure that the offender makes some form of recompense to the community that was affected by their offence. Since April 2005 a new offence called a Community Order has been available to the courts. As with all sentences that a court can hand down, if you believe a mistake has been made, you can make a formal complaint via the court that heard your case.

Examples of community sentencing that you could be ordered to carry out by the court hearing your case includes:

  • Unpaid work to help your local community. This could include collecting litter, helping charities or assisting your local authority removing graffiti
  • Regularly visiting a probation officer to help you improve your behaviour
  • Curfews may be imposed by the court

If you are a young offender that is defined as anyone under the age of 17, the court dealing with your case could give you a number of different sentences based on the offence that you committed. The Youth Justice System handles these types of offences. You can see more details on their website. Sentences such as community rehabilitation orders will mean you will be supervised by a probation officer or by someone from your local Youth Offending Team.

I've been asking to move office for the last 3 months. My probation office has refused to move me.ive served 2 years on licence without any problems and seems the office I'm with want help me with nothing .I'm going round in circles. I should of been moved because of the area. But when tried to be negative towards me and I asked not to there playing games.and it strongly feel they are provoking me to a breach and no other probstion will not give me advice

My partner has been recalled for allegations against him, these were retracted straight away and no police involvement, his probation have falsified information on his dossier and they have withheld information, his scores are all low/medium, his probation are not backing his release even though now new charges brought and no breaking of licence conditions how can this be ???? What is he is chances of release on the papers ??

When I was given 200 hours unpaid work to complete, I was not working but the probation service couldn’t place me at the time. Now I’m working full time (and then some in order to pay bills and keep a roof over my head) and unable to complete any unpaid hours - especially with my mental health being quite bad, it’s a struggle to get out of bed most days. Is there another way this can be approached and paid back eg an additional fine instead?

Hi I was put on a 24 months 2 years suspend sentence I missed a couple of appointments due to my serve mental and I let them know that I could not attend because I had suicidal thoughts been recalled back to court and now I have been attending all my appointments and I am going back to work and I was just wondering what will happen when I go to court thanks

I was sentenced to 100 hrs unpaid work, but and the probation service applied for an extension which was rejected by the court. I'm not sure what this means? The probation officer said they'll be in touch if they decide to pursue the matter, but I don't know what happens now.

I’m coming to the end of a 18 month suspended sentence and I have completed my unpaid work hours but not my RAR days when my suspended sentence is up do I legally have to do them. They haven’t bothered to get me to do them during the 18 months

My 21yr old son has just been released from prison. Before he was released I thought he would be coming back to my address. A week before my sons social worker called and said if I knew he would not be allowed home and that my son was not aware. I have suffered with my mental health for many years and last year attempted to take my life. My son was in prison from May 2020. He was calling me every day and said I shouldn't worry as he would be out soon to help me and his grandmother. The last few months I have been engaging with the mental health team and was getting better with the prospect of my son coming home. Then my son was told that he was going to an AP then he wasn't , then he was. No one knew where my son would going on release from prison and my son also had not been told anything about license conditions. On 1st September 2021 my son was told that he would be going into shared accommodation and has a curfew 7am till7pm. Today he has gone to the accommodation it is not fit for a dog. There's broken windows furniture dumped in the garden and the area is not good. It is an area where bad things happen on a day to day basis. My son does not know anyone in the area and I thought probation was to help the offender from offending again , my concerns as much as he's an adult, he's withdrawn and I don't want for him to get himself mixed up with others. There's nothing wrong with where we live he has got his bedroom. He knows what he wants to do now with his life. There no criminal activity where we live. I cant see why he could not have just be sent home with a curfew. I cant see how his situation will be beneficial or a help to him in anyway. Yet some one I know who is just like my son was able to return back to their family home. I feel like no ones on the same page. It's like they want him to fail not better himself

Can Probaition stick another 6 months to my order without a court order , my 2 year court sentence has almost come to an end but I have been given this 6 month extension due to COVID it was out of my control I’ve paid over 1700 in fines attending courses and any Probaition I have been given without fail but 250 hours community payback still outstanding due to this can someone please enlighten me many thanks

Hi my son has been recalled no one wants to tell me why and I am devastated to say the least. He was doing so well, then all of a sudden there was the police knocking at his door. If you don't attend probation and have also failed to attend any community service, is there a high possibility that a prison sentence will be sentenced? I've never been to prison before and that was my first court appearance and first arrest and what not, however I never attended either probation or community service, I'm well aware that a warrant was issued (this was almost 2 years ago since they issued my arrest warrant) when they finally catch up with me, is It more than likely that a custodial sentence will be issued??

Nps officer isnt even trying to contact me about my husband returning to the family home he went to approved premises on a short basis 3 months max while ss safeguarding was conducted all this was done within 3 weeks ss have no problem with my husband returning to the family and asked for a transition date to be asap yet nps still haven't let my husband home and refuses to even contact me how us he supposed to return home wen. Nps officer refuses to speak to me about it surely this is not right she is making my family life miserable and is causing my 5 year old grandson who has only his grandad as a male in his life to cry and get upset any advice pks

Hi, I wondered if someone could help, my ex admitted assault by beating in Jan 2020 to myself. He was given a community order and probation for 2 years. In the 2 years during probation can he come anywhere near me? I have a non-molestation order at the moment which runs out in March but worried I won't get an extension and he will come round.

My husband got 12 month probation and 60 hours unpaid work for drink driving, which started back in March last year. Because of the lockdown and later injury to his leg he wasn't able to start it. Now, he has a court hearing next month. What should we expect, and is it possible that court order will be revoked as he still is unable to walk properly. Thank you

The police target anyone who has cropped up before In the criminal justice system .You can be accused of all sorts of things without actually doing anything.I was in a relationship three years ago ,the police would be called due to arguing and crying .when the police got there it was just me left crying and hysterical from trauma and abuse ,they would then say they have no choice but to arrested me.they were coming out at least twice a week and 95% of the time they would take me to the cells for "assaulting them" where they would continue to assault me.i was once so uncontrollably upset that after they stripped me naked a police women stuck her hand inside me searching my stomach for treasure or maybe interserting some kind of spying equipment I don't know what she was thinking. The day came where I could not take the police abuse aswell as my partner's anymore.I chased him ,I wanted him to die I was in so much pain I couldn't understand how I could feel it... Could I have some help please . Me and my ex partner are separated with me having a new partner. . 2 years ago I called police to him “kicking off” at my property to which the police attended he was refusing to leave , they went to his property where he got Arsey with them and declined arrest for 10 hours and later got remanded for having 2 CS gas in his property. He was not charged with anything to do with myself , but got 29 months for firearms . He went to prison and me and the children have had regular visits , and made a good friendship and mutual ground , we had plans in regards to the kids for when he returned ( not in a relationship ) When he was released from prison his lisence condition was that he can’t contact me or come to my home etc even though he wasn’t convicted of anything to do with me , and the judge hasn’t recommended no contact me . I’ve been visiting the prison for 18month with the children which his then probation officer new and was fine about . Now I’m being told we can’t have contact for 12 months . Is this allowed ? Seeing as his sentence is for possessing firearms in his property Also I rang the probation officer who told me if I wish to discuss anything with him then I am to write it in a book and give it to her to check before she allows him to read it . Am I right In reminding her that I’m not on probation or under any obligation to do that due to the fact I have no conditions on me ... so actually I could text him what I need to say , and it’s only if he replies that it’s breAched . He hasn’t breached if I’ve messaged him as I’m not the one who’s got conditions? Also does anyon know if I have any rights to be removed off the conditions ? Sorry for the long post ha ha

schedule in place where my husband cannot leave his house for more than 24 hours. I live 4 hours away. Probation have then gone into say that he could visit for the weekend whole he does his order upw bbr and rar in the weekday however when he has informed probation he is visiting his family as he was told he could Friday to Sunday probation are meeting him on the Friday and now have said he cannot leave for more then 24 hours can probation do this if there is no court order deemed for this? He has asked for the paper work and they refuse to give it social services and not belong the matter saying he is welcomed to come down but will not inform probation that they are aware of him coming as they say it's not their job but probation will not let him come down unless SoCal services say to them they are aware. My husband is scared of being breached again he is beginning to give up and they continue to destoy his mental health. Can probation place a 24hour return to home address without applaying to court for it? My husband is engaging with all his orders. Need help advice with this please.

Cf94. Ive just had a court case for using someone else's card I spent£238 but paid back £250. I've got 80 hours unpaid work ,£408 fine and 3 months electronic tag at night. I've lost my job also. I've refused to wear the tag so no doubt I'll be back in court soon.I have mental health issue and can't wear a tag,I'd rather be dead. Scared I'm going to prison.

I was kidnapped and assaulted by a far right racist. I managed to escape and call the police. I blacked out as I had my head smashed off against a wall several time and woke up the next day in a police cell. I had been done for drunk and disorderly (I had a bad head injury) assaulting a police officer (apparently I kicked a police officer but there was no evidence on body cam but was told his word would be believed over mine) and having a knuckleduster (has a rucksack and a 2inch pen knife was found deep in the lining of the bag I didn’t know was there). Bromley Police berated me the next Day saying if I wanted to press charges on the man they could keep me in the cells for 48 hours. My crap solicitor at court told me to plead guilty (basically she knew I wasn’t got to be a big earner for her) and I was in such a mess I couldn’t handle a court case. Now have 120 community service. Probation officer has told me because of covid she is going to apply for an extension of my 12 month community order which means it won’t be spent for another year. The system is a joke. Found out later the police tried to get me back in the house with the man that attacked me. Tell your daughters to be careful because the police hate women and have no idea how to handle cases like this. I was threatened with jail time if I took the matter with the man any further so I believe their may be corruption with Bromley police.

Hi My son is currently doing unpaid work for a 12 month suspended sentence last October. He is currently under mental health for unstable emotional state, dissocial behaviour and they have given him medication. He has struggled before and at the start of the lockdown but with my husband's, mental health, his PA and my help he is a different boy. He was a smelly dirty, choosing non positive friends, he couldn't sleep and was not eating and his flat reflected this by being really filthy. My husband and him got his flat cleaned up. He has always done the unpaid work but has clashed with the supervisor (which he still has now). He has over the last couple of months been with me on various gardening jobs with various clients. I have had no problem working with him and I can see he has gained the respect of our clients by being polite, hardworking and taking inititiative. He has asked repeatedly to change his work group so that he can work with another supervisor. This has been refused and he has now been told by his new probation manager that his case is going back to courts. One of our clients who is a Barrister has known my son for some time and has written a character reference to be given to the probation manager ...she did read it finally...If this goes back to court what will be the outcome of this...will he go to prison...and how can we help with this

A friend of mine used a card of an individual she was looking after and with drew 1000 pounds. She had postnatal depression and was in debt with threats of bailiffs. She has participated in a voluntary interview and admitted everything. She's now waiting to hear back. This is her first ever offence, will she be looking at a community order or much more?

Hi am need some help on my son he has disability and learning disabilities and OCD ADHD he was in court for missing probation and he was on 12 months tag and got taken of it early go 24 months where shouldn't get in trouble fine of 1000 pound and pay back and he had some changes in is life and a lot of health problems and mental health he had sick notes and because of missing probation he done most of is tag so he had it taken of he gone to court thinking he wouldn't go to jail and he had sick notes for missed appointment i need help on how to appeal with is case evidence he has to say he been I'll alone side is hospital appointments and don't think it's right he been sent too jail with all the in payed and fine and tag he done and not taken any of that in to it and sent him to jail no one helping him to understand things when he as learning disabilities I need to get help on trying to appeal on it anyone help me thanks

I pleaded guilty on the advice of my solicitor who advised plead guilty as it will all go away. So on his professional advice I did. What a fool was I. I now have 3 Assaulted and Battery charges and 2 for criminal damage. I did not commit 3 of these offences and I understand we all say that but I didn't. He kept telling me to plead guilty he wore me down so I pleaded guilty. What a fool was I. At the magistrate court hearing nothing that happened to me came out. I was assaulted by 2 of the so called victims. One who says he is disabled but still is able to drive an articulated lorry. The magistrate's say it was a hate crime. I have constantly been indimitaded by 1 of the umm victims. I have scars on my body and 1 of the victims states in his witnessed statement he pushed me over. My partner was hit over the head by the victims and had to go to hospital. As I at the time of court had a sick note due to anxiety and stress I was unable to do comunity pay back. They sentence me to 5 month curfew from 7pm to 7am 7 days a week. My family live a 3 hour drive from me. My mum is in a care home in the final stages of dimension. My dad is 86 has cancer and other major health issues but those lovely magistrates did not give a dam. I might as well have gone to prison. This was my first effence. Even the prosecutor was shocked at the harshness of the sentence. I am totally devastated as I am unable to see my family. For all of you in this situation I wish you the strength to get through this. I am totally devastated.

I am a female & was charged with drink driving & was given 200 hours by the courts & ordered to see a probation officer on a weekly/two weekly basis. The probation officer didnt think it suitable for me to be collected by the probation services van they provided me & sweep streets etc & placed me in a local womens centre instead. I am now having to provide me own transport by which I have completed 50 hours costing me £150 on the bus so far. Is this fair because I really cannot afford a further £450 to complete the hours?

Hello my boyfriend went to court and received a fine and community service, he missed two community services while I was pregnant, the first breach was due to me having virtigo and he didn’t want to leave me on my own to look after a one year old and be pregnant when I was having an episode. We’re now worried That he’s going on to go to prison, does anyone have any ideas on what will most likely happen

Hi there my friend had court in England in April for using a company credit card and obtained £10,000. It was found that he was suffering from PTSD as a result of 3 tours in Afghanistan and had secretly began gambling. He was spared 8 years in jail and given a suspended sentence and suspended for two years months, and must pay £3,721.17 in compensation. He must also complete a 25-day rehabilitation order within two years, as well as 150 hours of unpaid work within 12 months. What does the 25 rehabilitation order mean? And suspended sentence? I’ve not heard from him in 2 weeks as I live in Scotland and I’m worried he’s ended up in jail and I have no way of finding out as I don’t know how to contact his family. Can I find out if he’s in jail?

My boyfriend has been told he has missed an appointment with the probation officer that he knew nothing about. He was living with me but temporarily moved back to Wales and requested to have probation moved there. He has been trying to contact his original probation officer and was told to wait for a letter which he didnt get. He's going to the probation office first thing in the morning but we're now worried that he'll be recalled to prison. Can they do that if he never knew of the appointment and has chased the original officer?

Jpalmer31 the order or the hours will not disappear. Your community service must take priority. Itnis only 60 hours so not impossible. I've seen people do that amount in less than 2 weeks. If you fail to do them, prepare to go to court as you will be in breach of the order. Fail to turn up at court and a warrant will be issued for your arrest. It will only go on longer and cost more.

Im on a community order for criminal damage i have been complying but i havent turned up to every appointment or unpaid work i got 80hours i got my hours down to 4 but then was breached i got extra 20 but i then got a job i tried to let my om know but couldnt get hold of her ive now been breached again if i were to go jail when released will i still have to serve my community order im on cause if so thats being sentenced twice aint it

Can anyone give me some advice, I have 60 hours left on my cs order, I’ve recently self funded to get my qualifications to go work on the wind turbines, it’s working away and have just had my interview. Was just wondering if I get offered the job what will happen with community order. Will I get breached. Don’t want it effecting my new career.

Hi, my brother was issued with 200 hrs community service. He didn’t show to any, he then got sent back to court and got an extra 50 hours. He still didn’t show for any and now a warrant is out for his arrest. Is he likely to go to prison as he’s got sentenced originally in early 2019.

Hi, I was wondering if you could please help me. My partner's currently on PSS for common assault towards me. His PSS ends in October. His parents are making it very difficult for us to have any kind of relationship and has blackmailed my partner saying that they will tell probation he's been staying in my home with our daughter (which is untrue). They've given him the ultimatum of he either leaves me and stays living with them in misery or they'll ring probation and telk them he's broke PSS which is untrue. I was just wondering what the procedures are with him changing address and living with me. I can't cope seeing him do miserable and hurting there. The plan is for him to move straight back after PSS. I know a lot of other couples have hAd their homes approved. Please help. I'm at my Witt's end and my partner is contemplating walking away from our relationship over this because he's so scared to go back. Please help!!!!

Hello I have around 90 hours of community work still to complete by November 2019. Due to many stand downs by the Probation service, I may not have the time to complete the hours? Will the sentence be revoked after the 12 months has passed? Thank you.

My son served 2.5yrs of a 4yr sentence. He was released on licence and has to report to probation for the next 2yr. He has done a year on licence and has a year left. He has been arrested for an alleged assault. He was released from the police station, with charges and a court date...(2 months time). Then the police turned up 2 days later, told him to pack a bag and they took him back to jail. He hasnt been to court, he hasnt been found guilty. He has been in the prison for nearly 4 week now, his court date is another 3 week. Just that i was reading the above and it says, probation will send you to court and a judge will decide if you should go back to jail. Can anyone give me an answer? Please

I have never committed a crime as such, i was in possession of a knife in my vehicle that i use for work purposes in a work van. I was told in court I had a 12 week prison sentence suspended for 12 months and had to do 25 days R&R I am now being told by probation that I have to attend at least once a month who do I listen to as there was no mention of being supervised in court

3rd time back at crown for breaching unpaid work.. Anyone know if I'm likely to go to prison?? Last time I did not attend. I did try calling the office to do an extra day to make up for the missed one.. Its just so difficult. Getting through on a phone. Bloody ridiculous.

Hi my son is 20 he got into a fight on a night out last Christmas he only got involved to defend his cousin who was being held down to the floor by a guy who had his hands around his throat he was turning blue my son ran to his defence with his other cousin they pulled the guy off him a scuffle broke out the mistake they made was kicking the guy while he was on the floor it didn't last long no harm was done to either side but they got arrested after a doorman rang police the footage was on cctv so my son and 2 nephews where given 300 hrs a 2 year suspended sentence and a big fine! My son works 3 different shift patterns and breeched it on the Saturday after the long shift he had done the night before so his probation officer sent him back to court though he did ring a couple days later and ask her for another chance she said no it's too late I've already sent it to court so he goes the magistrates and the letter was read out from the pbo saying he would benefit more by going to jail so he's now back up in the crown court 22-12-18 just days before Christmas he has still been going and doing the hours every Saturday he's a good lad who works hard and never got in bother before now he feels he's being treated like a naughty criminal his probation officer has done nothing to help only seems to be making his life worse sending him to prison would mean him loosing his job when he worked so hard to get the job after always being in dead end warehouse jobs since leaving school he's only 20 and finally things where starting to fall into place for him he was starting to see a brighter future for himself I don't know what to do to help him it breaks my heart and his little sisters we are so afraid he's not going to be here for Christmas we can't afford solicitors fees I can't understand why this probation being so hard on him he's tried ringing a couple of times to ask can he be transferred but he gets told she's not in the office yet leaves messages and she never rings him back feel like theirs no help at all and the judge will just take her advice and lock him up my son does not need locking up or any sort of counsiling he never went out and commited a crime intentionally it was an incident that happened in the heat of the moment yet hes got a heavy punishment like he really deserves it what are the chances him being locked up for Christmas??

Hi, my partner got 18 months probation, 12 months driving ban and 60 hours unpaid work.... I don’t understand what the 18 months probation is? It was for dangerous driving. He’s had two meeting so far with probation and says there are quite a few people in these meetings and it’s about employment, however he’s only jobless because of the driving ban as he was a courier. They have said there are two meetings left. So what is the 18 months for? I am so confused and he doesn’t quite understand either

One of my work colleagues works from 7 until 6 each week day (5-6 is overtime) and Saturday 7-1pm (all overtime) He's been ordered to do 200 hrs community service and has to do this on a Sunday from 9 until 5. He also has to go to an anger management or some sort of family course from Monday evening from 5pm until 7pm. This seems excessive as he works pretty much all the time and Sunday is the only time he can rest or see his family. His English is very poor and I think he's not been able to fight his corner when it came to this. Is there a way he can get the community service reduced to say, half the hours on a Sunday?

Hello, I have today been informed by my probation officer that I am no longer able to partake in the Building Better Relationships program that I have been partaking in and completed the introduction and three one on one sessions. The reason I was given was that they do not feel that the program can help me as I do not recognize any unhelpful behaviors within myself. I was convicted of Section 20, Wounding and sentenced to 12 months suspended, 100 hours community service, a fine and to attend and partake in the BBR program. I have completed all of the community service, have attended all appointments, and have been paying the fine. My probation officer has stated that because I am no longer on the BBR program, the matter must go back to court and my probation officer feels that because I am not on the BBR program, the alternative of 1 on 1 sessions with my probation officer directly, to address my offending behavior, is not suitable. I am concerned, as without an alternative, I feel that a judge is likely to sentence me to the original custodial sentence. I have no prior convictions and have not been in any incidents since my original arrest. What options might be available to me in order to reduce the chances of a custodial sentence and is a judge able to quash the BBR part of the sentence on grounds that this was a decision made by probation and not from a lack of attendance or engaging within the program? I am very concerned about this and would like some help. Thank you.

I have been given 2 years community order with 20 hours RAR, 140 hours unpaid work and £300 fine along with SOR and SHPO and Horizon. So after 20 hours RAR, 140 hours of work, paying £300 fine and Horizon program can I migrate to another country before 2 years or I would have to stay here in UK for 2 years ?

Hi, my husband was convicted on 26th June 2014 for common assault and was sentenced to 6 months in prison suspended for 24 months, 150 hours community order and a 12 month supervision order. He breached his community order (by not completing his community service within the 12 months) so he was given an extra 12 months on his supervision order (which ended on 26th June 2016). However prior to it ending he breached his supervision order by missing an appointment therefore the judge added 3 months on to his initial suspended sentence (so suspended for 27 months in total), taking him to September 2016. We are now trying to work out with the addition of the breaches and further sentencing whether his sentence is spent or not?

This is a tricky question to answer, as while a person can be 'disqualified by association', unless your son is being convicted of supplying drugs to a minor, then this is unlikely to figure. As a rule, the relevant offences of disqualification by association are offences against children, and a comprehensive list can be found in tables 4 and 5 of Ofsted’s handbook.

My son was given community service, broke his foot and had to go back to court as couldn't do the community service with a broken foot. Waited for another letter for a start date to do the community service, when the letter arrived, the start date was a week before he received the letter, now he us most probably looking at a jail sentence through no fault of his own,

I’m currently on Probation for a domestic battery offence. I’m in court on Friday for breaching this by missing one appointment. Earlier this week my girlfriend and I had another row and the police were called. I was not arrested straight away but they asked me to come in for an interview, saying that no statement was made by my girlfriend and they just wanted to talk to me. When the interview started she read out a police statement that said my girlfriend had told him I’d grabbed her wrists. What is the likelihood of this going to court, and if it does, considering this is a breach of my probation again, will I face jail time?

My partner was sentenced to 1 year probation, 3 months on tag and 14 month driving ban for driving with an illegal substance in his system. The 3 months have passed so tag is off but he desperately wants to go to rehab. We are looking at a few in the UK and one in Italy. Will he be allowed to go even though he still has over 6 months left of probation? His officer said it wouldn't be easy but perhaps if he showed commitment and attended every Lifeline appointment over the next few months then they might pay for a 10 day detox. Detox is not what he needs. He needs at least 3 months of rehab which includes detox, daily therapy sessions and the 12 step programme. What are his rights? Surely as the offence was drug related it would be in everyone's interest for him to go to rehab and do it properly (all 3 stages) this could mean being away for a year. We are not asking for the system to pay for it either.

My ex partner got community service for breaching his non molestation order 4 times last year. He got over 100hours all together. Hasn't done no more than 20 hours he got called back to court in March this year got more hours and more fines. To which he hasn't paid a penny of his fines nd still hasn't done his community service. Now his probation officer wants to take it back to court to get the community service dropped as he don't think it is doing him any good. .and he is still coming and ringing me making threats.. could this all be real as many people I have spoke to have said how can he getaway with this .what other option can the judge give nd would the judge drop the community service order . My partner was convicted and got 250 hours community service, he only had 16 hours left to do but he was then sentenced to 2 years in prison. They were two separate charges and went to court at different times but both offences occurred at the same time. The judge put two weeks concurrent sentence on for the 2 days of community service that he didn't complete. Does this mean that he won't be eligible for HDC?

I have been given 120 hours for common Assault, I am in the process of appealing the conviction and today had a case review hearing and was given a hearing date for the end of July, I have asked the judge to put the work order on hold pending the appeal as so far I have completed 40 hours and will have finished by the new hearing date, but the judge was unsure of his powers to suspend the order and I am still waiting for an answer

People need to ear in mind that 'probation' has now been split into two types. The NPS only deal with MAPPA/high risk cases. Everyone else is managed by CRC private companies which are diffierent according to the area of the country.

I have a 100hr community service order but work full time, have a young child and already do voluntary work with a charity, my daughters school and a local sports club. I'm really struggling to fit in full days community service - can my current volunteer work be taken into account. I made a huge mistake when struggling with mental health issues and I accept I need to recompense for that but it would take my time away from other good causes.

My partner had a suspended sentence for 18 months. This took a whole year for them to start his community service because his probation workers kept changing. He was advised to attend a healtg and safety course which he told his probation worker at the time he couldnt attend at short notice due to work commitements. A letter was also written by his boss for proof. She said that was fine and he attended the following week. He has also done a block of 6 days straight to get most of it done. And now doing it every sunday since it was all made clear when he should be doing it. The probation worker said she wouldnt breech him but she has. He now has to go back to court. Due to mixed signals etc and him actually wanted to do it to get it done what do you think the outcome would be?

My daughter s just completed a 28 curfew for a drink driving offence. She was surprised to get a summons to go to court for a breach of conditions without reasonable explanation. The time oh the incident seems to relate to when the tag fell off because it was either faulty or not fitted correctly (I was present when it was fitted and the officer almost went to get a different unit as she had trouble fitting it). She was contacted straight away by phone, she explained what had happened and another tag was fitted the same day. We assumed that was the end of the matter. At no time has she been asked for a formal explanation. She has asked for a copy of the report sent the enforcement officer but this has not materialised. What will happen at court? What can she do before the court date? She has tried ringing the phone no on the summons but just gets an automatic response. Has correct procedure been followed here?

I was wrong fully convicted of a crime. I pleaded not guilty. I logged an appeal with the magistrates straight away even before sentencing. I was given a community order of 100 hours which I completed. I have now won my appeal at the crown court. So effectively the crime never took place. But the punishment did. Should I be entitled to compensation for the 100 hours community service I worked ? Also. The wrong conviction directly ended my job as a security guard. The SIA would not renew my badge so I could not continue the job I had been in for 6 years. So the wrong decision by Scarborough Magistrates directly stopped my career. I believe I should be entitled to compensation for that ? How do I go about that ? Thank you.

I ve been sentenced to 80 hours community service and because I work away and at weekends the court has given me 12 months to complete it. I ve been in touch with the probation officer and she has informed me that I have to guarantee at least one day a week or it will be referred back to court and I will get a custodial sentence because I can't guarantee one day a week. After much haggling and pleading from myself she agreed to one day every fortnight but due to my work I can't guarantee that as some weekends I don't manage to get back home. If the court has given me 12 months to complete the order why is she telling me I ve got to complete it within a couple of months ? This is stressing me out quite a bit at the moment because if my boss hears about it I will get sacked. Any help would be greatly appreciated.

Hi My son has problems with drugs. He was also attending the probation form 2015. His licenence was about to finish in November 2016. we as a family was very worried as he was on Methadone form 9 months but his mental and physical health wasnt improving. he was having suicidal thoughts. He was trying to get the job but struggling because of his records. He was trying to attend the local community recovery groups for support but nothing was working. We as a family decided to send him for rehab. Searched in the uk and visited some they were far more expensive than over pocket. We found one out side the country and send him for treatment in September. He is still going through the recovery. We gave all the details to probation after he was admitted. There was no correspondence received from the probation however today the police officer came on the door and told us that they have arrest warrant for my son for not attending court for not attending probation. We got very worried as we have told everything to the probation and nothing was hidden. We want to know how the arrest warrant can be removed as when he will come back to the country it will flag up. He is doing really well and we feel that it is going to create another barrier for him. Please advise.

I think in this case you may wish to speak to Women's Aid, , or Offenders' Families helpline here as you don't say who made you sign the form (i.e the court or Social Services) and whether the form is binding. Therefore, it makes it difficult to advise. However, please keep in mind that if you do visit your partner against any order, then the visit will be logged and recorded and this may impact upon you in the future.

Hi My son's probation officer has asked him to provide a family tree going back to great grandparents to show his support network. He is supposed to provide names, ages and who knows about his conviction and who is supportive. We have asked all the people concerned and with the exception of one person all have said they don't want their details (names & ages) being used. They have said it is ok to put their relationship with my son and whether they know and/or support him but no other details. Is this ok ? Hi my partner just got convicted and is a serving a year in prison for assualt on me, he broke my finger and gave me a really bad black eye amongst other things, the cps carried in with a victimless prosecution as I found it too difficult and impossible too give evidence against him. This may sound very ridiculous but he was made to sign a form to not contact me nor can I visit him, my mother I think was behind this as I accidentally told her he called me once from prison. Are there any laws strictly stopping me from being able to visit my ex partner ? How do I now make it possible to visit him ? When you are given probation, it is conditional that you report to your probation officer. If you fail to report to your scheduled appointment, you run the risk of your probation officer charging you with a probation violation, which would mean you would have to once again appear before the court for the judge to decide what your punishment will be. The punishment may mean you have to serve the remaining amount of time of your original sentence. However, we cannot predict what course of action your probation officer will take. Hi i was wondering my husband as to go to court with domestic violence towards me. I had asked this to not go to court but the pps have went ahead with it. He was convicted back in 2006/7 with a 2 year probation order with the same offence. There has been no more violence towards me right up to this september. Wondering would he go to prison. Wee have been laising with social service. He has to go on an anger management course that social services have put him on. If he presents this to the court on his date to plead gulity or not guilty would this help with the case. Wee dont want him going to prison due to having a 1 year old. He would lose his job and I would not be intitled to any benifits or anything.

I have been sentenced to 200 hours of community work I have done aroun 40 h pay back, I had to leave the country and go abroad for personal reasons with no much explaining to my probation officer. If a foreign national is convicted of a criminal offence which results in a prison sentence they are liable to be deported when they are released for prison. The more serious the offence, the more likely a judge is to recommend that the foreign national be deported.

Booking a holiday at such a precarious time was probably not the best idea. Likewise, cutting your tag and going away without permission is not a good idea either, and you will face serious repercussions on your return. Your solicitor will be able to advise you on your best course of action should the CPS not give a reply.

I've been on tag for over 21months for a crime I had a court date which ended up being moved due to a police witness was on annual leave but I booked a holiday months after my court date as I thought I would of been dealt with. The cps and police are dragging there heels to give me a decision on going on holiday for a week. It depends whether you're guilty or not. If you are serving a supspended sentence and you commit another offence within the period your sentence has been suspended, then you may be formally sentenced for the original offence and your most recent one. However, we can't anticipate what a judge may decide.

My son was charged last Nov and given a two year community order, namely to see probation, for them to supposedly work intensively with him on a one to one basis. He has learning disabilities and struggles to engage with anyone. To cut a long story short, he breached a court order and has been sent to Crown Court again on 18/08. The Probation Officer has written a terrible report stating him to be a liar and not willing to work with probation. She was given a copy of the psychological report back at the first meeting, and ignored everything in it. Each meeting has only lasted between five and ten minutes, and she has not done any work with him. The report from her given to the Magistrates Court (where he first appeared) is in my opinion very wrong, and I strongly believe she is not in a position to write this report, she has failed him. Can I complain and will it make things worse? I am very worried. Thanks

My partner has been arrested this morning at the police station, he was told he was going to be charged for a further offence when he got there they gave him a court date for his new offence (importation) but then arrested him for breaching probation, they are holding him in police station until tomorrow to attend crown court, he is on a 2 year suspended sentence and has breached probation before this time he had handed in 2 sick notes to cover the dates he was due to attend probation, my question is can they keep him in on remand until his new court date relating to importation or will they make him carry out the rest of his suspended sentence?

Hi, I was given 16 week curfew for a first time drink driving offence. I have no previous convictions and there was no aggravating factors in my case. Not only in my opinion but solicitors and a police sargent agree that my sentance was really harsh but I didn't want to appeal due to the fact I'd be in crown court and magistrates was bad enough! I was given 10 weeks custody suspended for 18 month, 16 weeks curfew, £200 fine and 3 years ban. It says on the reverse side of court papers ither you or your probation officer can ask to have the order changed, reduced or removed. I'm yet to hear or be allocated a probation officer, it's been 5 weeks on curfew now. Is there any hope of getting this thing off early?

Before the first court hearing, the police can also retain a defendant in custody or grant bail, with or without conditions attached, but their powers to do so are more limited than the court's. Conditions can only be imposed to ensure that the defendant attends the next court hearing, commits no new offences in the meantime, and does not interfere with any witnesses or obstruct the course of justice. An individual who was took to court for assault x2, criminal damage x2, driving without a licence. he was sentenced to community service, rehabilitation, and 6 points on his non existant licence. I have a manager of a charity shop who takes on people who are on probation, but she is signing off hours they HAVENT done and forging their signatures on the sign off sheet for hours, even accepted money from one person for signing off their hours. I have been informed I will b returned to court for missing my community service although I was signed off by my doctor as I have suspected sciatica but I did not submit the evidence however the probation service did not contact me via letter asking for evidence with in 5 days of the breach in fact not at all and when I was trying to phone them the number provided online was in correct do I have a case to argue when I return to court.

Hi, My son was given a community order to serve in January 2015, which consisted of a fine and community service. He has now paid the fine off, but didn't do most of the community service, so was given a 12 weeks suspended sentence (suspended for 12 months) in September 2015. He has now committed a further offence (March 2016) and is in court next Wednesday. Will he automatically go to prison? His solicitor has told him to plead not guilty but I don't think this is a good idea as he was guilty. He is trying to get his life back on track since I kicked him out just over a week ago when he was arrested, because this was a wake up call. Is there any mitigation, because if he goes to prison this is going to knock him back again and he sufffers from depression and anxiety already. The offences that he committed where actually towards me and my property.

I was recently accused of overpayment of housing benefit, JSA and community charge. I was taken to court and given a fine of £4,000, plus court costs of £220 together with community service in a charity shop of 120 hour. I work full time monday to friday 9am until 5pm and will have to work in a charity shop every Saturday for a minimum of 7 hours per week. I suffer from M.E. and fibramayalga very severely and am on permanent medication. I have a 9 year old son and am constanly aching, have headaches and am extremely tired because of the condition. Is there anything atall that can be done to reduce the hours due to my condition?

Accoring to the CPS, from a sentencing point of view, the typical case of blackmail perhaps falls somewhere between robbery and simple theft in terms of seriousness. It is usually less serious than robbery because no violence is involved nor the threat of any violence. On the other hand it is clearly more serious than theft because of the mental anguish which is so often caused. Your friend would have to seek legal advice regarding any appeal.

im writing on behalf of a friend whos been locked up yesterday, the thing is he basically tried to blackmail some girl into giving him money him and another guy the other guy has had a previous conviction of the same offence, during court he blamed my friend and both of them have been given a sentence of one year firstly I want to know if I could appeal on his behalf due to the reason he did not take any money and secondly its his first offence whilst its the other guys second and secondly I wanted to know if we could appeal for his time to be reduced and replaced with community service id really appreciate it if I could be given a response a soon as thank you.

You should really visit your GP for some advice. Regardless of your mental health issues, if you haven't turned up for your community service work, or drug rehabilitation programme then you will be recalled to court and made to serve your sentence.

I was sentenced too an 8 week SS and 50 unpaid work and some drug rehabilitation thing, before my arrest and conviction I had no proir convictions at all never been spoken to by the police, my offence was carrying a knife which I had completely forgot was in my bag I feel like all this is completely unnecessary I had just lost my job proir to this incident and really can't handle all this I suffer with mental health issues the extent of my mental state is very unstable I haven't turned up to any of the things I've been requested to do, I have a narcissistic personality which is making this situation 100x more complex.

I have recently had a 3 month sentence suspended for 1 year, I have to attend alcohol awareness. sessions. I am 64 years old no previous record I am 65 years old next week. I informed my probation officer of a few days break my wife had booked for my birthday but my probation officer has said she controls my holidays and we will have to discuss and agree anything. The court did not place any restrictions on my movements. Is this approach standard or does it seem heavy handed. My "offence " caused no harm to anyone no damage and no financial loss. The probation officer wants to help me change my "thinking" but will not accept any evidence I produce or any other view other than her own. I am at a loss as to what to do Please can you advise

I’d like some advice for a friend. I may not have all the details but this is the story that I know. He has a no contact order with his ex-wife. He recently moved to another city that she followed him to. He has allowed her to stay with him as this was supposed to be very temporary 1-2 weeks. It is going on to 3 weeks and she is not making plans to leave. When he asks her what are he plans for leaving she threatens to call the police and send him to jail because of the no contact order. If he reports this situation to his parole officer, will he go to jail or can he expect some help in getting her removed for his home?

Hi, I was given a 10 month prison term. Done 4 month and a week inside and the rest on tag. Tag just came off. 5 months in total. Half of 10 months. Now my probation is saying I must keep reporting to probation to the end of ten months. That should not be the case because my sentence was less than 12 months

Hi, I have found myself in a situation in which I shouldn't be in. I was in a car accident on Boxing day 2015 in which a speeding van crashed into me as I was stationary. The crash sent me into what I thought at the time was shock but upon later analysis was discovered to be concussion by a doctor. A passing police car pulled over and apparently asked me for a breath sample as I was acting "drunk" (my memory for the event and the next two weeks has huge segments missing) according to the police I refused and was arrested for failing to provide a sample. Not one person, including my lawyers listened to the actual chain of events. The police lied in their statements saying I smelt of alcohol. I do not drink alcohol, I am sober, I was also training at the time for a Muay Thai fight. It was a rather serious crash, both vehicles were written off, yet the police officers never called an ambulance to attend even though actin "drunk" is one of the signs of possible head injury. I was sentence to 120 hours community service and my license was revoked. I lost my entire savings which I had invested into my career eventually leading me to being homeless, I now sleep on friends/mums sofas & floors. I could not afford to appeal & was told that if I did my sentence would be doubled. I used to suffer from serious depression but have been fine for years. I can't bring myself to go, the thought of being forced to do a sentence for something I did not knowingly do is making me ill again. I have been wronged by the system and it has ruined my life, I do not know what to do. I have lost all faith in the judicial system of this country. Please help.

If a person does not stick to the rules while on a community sentence, they could get a warning or be sent back to court. It is always important to let the offending manager know if there is an issue and he/she will act accordingly.

Hi my son has been recalled by his probation officer for not turning up to his appointment but it was cancelled anyway as I rang up to explain my son wouldn't be there as he was ill and spoke to his officer and I was informed they had a security breach and all appointments was cancelled not once did the probation officer tell me he had to go in but now he has recalled him which he has no right as my son has done nothing wrong the police are looking for him now with a chance of him going back to prison what legal advice can I seek please.

Hi im just finishing the first part of my gambling rehab I've done 16 weeks and I feel brand new I've got to go to court regarding a breech on a community order which to be fair I didn't do any hours I was given 100 hours but my life and head was in a terrible place I didn't attempt to do any to be fair gambling and finding money to gamble with was more my objective daily I hate myself for it as I should have been compliant with probation but my addiction was very bad at this point .I'm a changed person now and see life in a different way I no I've got the relapse prevention course to do when hopefully I come back the day after the court date I've got a brilliant letter from the rehab to give to the court but what is your opinion on my case as I'm worried to death about it now as ive done so much hard work and don't want it to be undone as there's more work to do at rehab.thanks kind regards.

It is very difficult to speculate what a court will decide. If a person breaches a court order continually then the court will take action. It is rare that a resident-parent is awarded a prson sentence (although it has happened in the past). While parents who refuse to accept the orders will be in contempt of court and risk serious penalties or even jail - a jail term is usually only considered as a last resort and a fine or community sentence may be awarded before a prison sentence. However, it really will depend upon the individual case.

If your partner refuses to comply with the order of community service, then it could land him in prison if he continued to breach it. Each offender is carefully assessed before they are assigned to a work project or placement. Therefore, I can only suggest he visits his GP to see if the GP can recommend a solution.

My son has 2 boys 1 aged four and 1 aged three , his x partner has broken court orders failed to turn up for at a court summons and breached a enforcement order, she snatched the boys off my son and myself in the street in broad daylight with the help of her brother, my son had the court order stating he had the boys a week before christmas and handed them back to her on Xmas day lunch time, she broke 2 court orders at the same time as it was his weekend to have his boys. The police were called but couldn't enforce her to hand the boys back, advised my son to get a emergency court hearing, which he did she failed to turn up for a court summons, then breached the enforcement order, which stated as soon as she read it she had to give the boys to my son , she claimed she hadn't read it as she wasn't handed ito her in person as she was out , the solicitor e mailed it to her and knew when she opened the e mail.she singed a statement saying she hadn't read it , but she clearly did . My son never saw his boys over Xmas he has them now for a week which he was agreed today at court. My question is can she go to prison for what she has done, as the judge wrote it in bold lettering on the enforcement order if she didn't hand the boys to my son , it could be prison community hours and a fine , She is so evil and lies so much , she has to attend court on the 26 jan to see what the punishment will be . If she went to prison would my son get full custordy of his boys . Hope to get a few answers , thanks for reading

I'm worried about my partner. Court issued him with 100hrs unpaid work & 3 month tag...& another 130 hours unpaid work. He successfully carried out the tag & the 100hrs. He had mental health issues that restricted him from even leaving house really bad episode. Which meant the remaining 130hrs was breached he has since been back at court & told to finish them again. He's undergoing many tests & working with community mental health team at present he really isn't in great place to be working in the public & suffers really bad paranoia & psychosis I'm worried he's going to breach again is there any alternatives a court can issue? He's completed & complied with everything before this has arose. It would relieve a lot of stress & anxiety on both him & myself

I was attacked by an older woman when I was 35 weeks pregnant and made me go into early labour, it all went to court and she was found guilty but because she was already on a suspended sentence they had to send her to crown court for sentencing but since then this same woman has attacked my mother in law and my aunty and attempted to hit me again but hasn't been remanded in custody. The next court date is January but she was found guilty of hitting me last November and I was just wondering why on a suspended sentence already she is still able to walk the streets?

You have to complete the Community Service as you could find yourself in worse trouble. Anticipatory anxiety is generally much worse than doing the actual deed, meaning you may find the 'thought' of doing Community Service, is worse than actually doing it. Your doctor will be able to help your through this period either by prescribing some medication that will help ease these negative thoughts, or by referring you to a counsellor. I hope this helps.

My ex partner has just been sent to prison for 24 months. I currently have custody if my daughter but would like to make it legal. We already have a residency order in place from court in which I had her around 40% and her mum 60%. This was amended by both of us, at our daughters request in as she felt that it wasn't fair that her mum had more time with her than me so we never have her exactly 50/50. I would like to know what my rights are now she is in custody? She is registered as her primary carer. I am in the process of going to her doctors, dentists etc and having the address details updated to mine but I am really confused as to what I can do legally as I have a feeling that once her mum is released she will want to move due to the embarrassment of what has happened and also she will be on license for 7.5 months and probation for a further 4.5 months after that so if she gets arrested or in trouble for anything she will go back to prison.

Hi. My ex partner has been sending messages threatening to smash my windows and get people to come after me. Hes also said he wants to kill me. We have a daughter together and now he's threatening to come and take her and wants to see her whenever he likes but I'm terrified as she is used too me all the time and I don't want her around an angry person she's only nearly 2. It is likely on any application form for a job he would have to disclose previous convictions and the date of those convictions. So, any potential emloyer will have to have knowledge of this.

My partner has just recently been given a community sentence of around 140 hours. He is currently unemployed. He has an appointment next week for an induction to see the probation to pair him up with a job in the community. The issues is, he has been offered a job to start in the new year but is now reluctant to take it. He has been told in any case if he has a job, he can just do 1 day per week, however he is not happy about having to tell the probation where he may be planning to work and getting his employer involved. He doesn't want probation ringing up the potential employer or writing to them. He has been given a letter in writing from the employer confirming an offer. Is it not a breach of his human rights and violation of his privacy if the probation get personal and ask to write or ring the employer where he could have a job waiting for him in new year? This will certainly cause an embarrassment and could potentially compromise the job, in which the employer may withdraw the offer. I am encouraging him to start the job as we certainly need the money, but he is not in a position to know what day he will be free each week as it is shift work. Any advice will be helpful.

My husbsnd is in prison he got his EDR . The probation officer cane checked the house and sent a positive report about his release but he is still not getting released . I went back to prison thry said they cant disclose me any information due to data protection and i went to his probation officer dhe said she is busy cant enquire the prison i dont know what to do Please do you have any idea how long hmp pentonville takes to release soneone who is over due by 4 days already . According to the Gov.UK site, prisoners get the same healthcare and treatment as anyone outside of prison. Treatment is free but has to be approved by a prison doctor or member of the healthcare team - for more information.

I have never been arrested or in trouble with the police in my life. I had a bad car crash last year as someone jumped a red light and smashed into my car alongside my family. We were not badly hurt but the car was right off. I got out and grabbed the driver and pushed someone who started to get involved. This went to court as the person involved was a QC and despite him admitting on a 999 call he jumped a red light, nothing came of it. I was summonsed to court for common assault and was given 240 hours community service and £500 fine. Everyone i have spoken to said this was outrageous. Is there any way of getting a tag or getting this thrown out at all? I have 180hrs left

Offenders on short jail terms must live at an agreed address and if they are sentenced to less than 12 months, and they are not allowed to travel abroad. There are also specific rules a person must follow and a probation officer might recommended extra conditions, such as; not making contact with certain people or keeping away from certain places where those people may reside. So, it is possible.

Remand means to hold the person in custody or on bail awaiting trial. If he is already on remand in prison, then if no bail application is made, or bail is refused, then he will remain in prison. I hope this makes sense.

Hi, Sorry maybe I didn't word it correctly. Community service is on a weekend so doesn't affect his work, it's just when he went on the Sat they had obviously cancelled it and not informed anyone, this apparently happens often which doesn't seem fair when it takes him so long to get to the meeting place AND probation they are last minute changing his appointments and they are during his work hours. He has probation once a week we live in a remote area so buses take over an hour to get to the city so he has to leave work early to get there, they made them for late afternoon because of this ( it's only been 3 weeks ) he received a phone call on Monday to say his time the following day had been changed to 10.00 so he had to tell his boss he couldn't work till the afternoon at short notice. He will miss 5 1/2hrs of work ( as buses take so long and we don't have them every hour ) instead of the usual 1hr off work. He's going to end up losing his job! Are they allowed to do this ? Also he has 200hrs community service. He catches the bus at 7.15 to be at the meeting place for 8.45. This weekend he did that and others turned up but the lift didn't so he had to wait to catch the next bus home so got back at gone 11. Apparently this happens often and the hours are not taken off his community service. Is that allowed and acceptable too ? Thank you.

Some of the stories here are a bit confusing. A couple of points to note though!! From a serving community payback officer! If the officer is sending you back to court he needs three non attendances with no contact before the start time to do so. If you have called in sick more than once in a six week period get a docs sick line. If you have a job the court must take this into account and comm service must not stop you from earning a wage as long as you tell them BEFORE you are due to attend for unpaid work. For those who have the ankle bracelet if you let the company know in advance and the probation officer holding your order that you will be late on a specific day it would be likely that the courts would be unable to enforce the breach. If you have breached an order and it is allowed to continue with no additional hours remember the officer only needs to give one warning to return. There is know real difference between scots and English law in relation to CPOs.Orders can be and are regularly transferred cross border. With regards to licenses data protection comes in here in quite a big way but if you are the victim speak to the probation/social work office closest to the court that the offender was sentenced at and they have a duty to tell you what has happened. The court system is difficult and most of the time people will tell you nothing about relatives and what has happened after a trial but there are charities who can help with the info. Look them up on the internet. Any other queries feel free to ask but Im based in Scotland although rules are the same in uk for CPOs

Hi there, My query relates to my ex. He has spent 3 of his 6 yr sentence in prison and was released on a 3 yr license last year. Over the 10 yrs we were together, there were many incidents of domestic violence although his prison sentence was drug related. Once he went to prison my support worker helped me to move and contacted probation to put certain terms on his license such as not to contact me, come to my new address e.c.t. However, this year when exchanging the children for one of his visits he assaulted me again. He was charged with this and his probation officer was made aware. He was not recalled and allowed to, for the next 5 months, continue to harass me. He followed me, he would pull up beside me and shout abuse, he smashed my car windscreen to name a few. I am considering complaining about the probation services as I believe they allowed him to continue to terrorise me and the children when he should have been recalled. He has been sentenced today and the Judge could not believe that he had not been recalled. When he contacted probation they said they had no intention of recalling him but were putting other things in place like more regular meetings. Only due to the judges persistence did they today agree to recall him. My question is did probation disregard the safety of me and my children by not recalling him after the assault, then subsequently after this? Should he have been recalled because he not only committed a crime whilst on license but also against me who is at high risk AND is a condition imposed on his license? I just thank God that nothing more serious happened because I may not have been here to write this message. Thank you.

My brother has been charged for having a weapon (knife) on him in a public place. He went to prison last year for threatening someone with a knife. He has been out a year and not been in any more trouble until now. He has a history of anxiety and depression and he is a heavy drinker and had a drink problem since he was a teenager. Since being charged he has tried to commit suicide a couple of times this week and says if he has to face prison again he would rather die. He is a different person sober and only does silly stuff when he's drunk and doesn't know what he's doing. Prison doesn't seem to be the place in which he will get help for his drink problem, it will make him worse and if he doesn't end up killing himself he will come out worse and back to square one. What's the chances of him getting a suspended sentence or a community sentence? He is too ill in hospital to see a solicitor and his court case is next week!!

I'm on a probation rehabilitation order (licence) and am due to expire of it in April 2016, am I likely to be able to go abroad for a week's holiday whilst on licence. I have asked my probation officer and awaiting an answer but want to know what my chances are of being successful. I've never missed an appointment and have kept all my terms of my license without any hitches. How does it affect me, if at all, and will my chances of being able to go abroad for a week be lessened because I'm on licence?

This has been the worse year of my life and resulted in my hanging myself on 5/615. I wasn't expected to pull through! My former friend is a former crown prosecutor and I have every reason to believe the Law was manipulated using her influence with the police ( this is currently now with the IPCC. It is a tragic outcome of events which has impacted on my mental health. A back door restraining order put in place without notice at an unconnected hearing despite no violence or intimidation. A defence who didn't represent me with real evidence they had to hand because all the way along I suspect it had implications for the CPS and they pulled rank with them. At the last hearing the Justice clerk disappeared behind scenes with the Magistrates to assist them with Legal advice but I have never know where a Clerk goes out back! I had asked my case be heard out of area. My former friend worked at Wessex, Surrey and Sussex. I have noted several contraventions to CPS guidelines in my case and I believe with skilful prosecution they were able to present a case far more serious than the ludicrity of a situation which was exacerbated by the mishandling of the case. I am devastated to receive a 12 month suspended sentence, a restraining order against me for 5 years with conditions of where I can and can not go local to where I live. I was also ordered to pay £1580 to prosecution costs despite being destitute with mounting debts! My offence was emails in the moment of crisis! My former friend has knowingly 'policed' me throughout a mental breakdown which included her policing my Facebook! My life is in tatters and I have no idea how to pursue a course of action or how to bravely expose the abuse of process. I have alt of evidence. Please advise how I go forth with this in order that I can move forward from this judicial nightmare to pick up the pieces to my life.

I can only suggest you take legal advice regarding this, especially as the courts have refused to enforce the order previously. However, if your circumstances have changed and you are in danger of losing the house, then some action may have to be taken. However, a lot would be based upon both his and your circumstances such as whether he is earning enough to pay the money owed, or pay towards the mortgage, which may be out of his control through lack of funds. Another factor the courts will take into consideration is whether you have children or not. You may be able to get some help from the Citizens Advice Bureau in the first instance.

My ex-husband and I signed a Consent order. He was to pay me an agreed amount within 2 years. it is now 7 years later and nothing has been paid. He has taken me to court to have the consent order set aside. The judgment was in my favour and the consent order remained in place but the Judge ruled "that the court refrains from the consent order being enforced". My ex has not paid anything and he is now further delinquent on mortgage payments; my accounts have been frozen because we remain joint on the property. Hello, I received a 120 day sentence suspended for 1 year as well as a supervison order with the probation service during the suspension in November of last year. The order is due to finish next month. During the order I have been compliant and have attended every weekly appointment with the probation service and have been making really good progress. Last week I was arrested and charged with criminal damage to my partners car causing under £100 worth of damage, because the incident involved my partner the case is going to be heard in domestic violence magistrates court. I would like to know the likely hood of the suspended sentence being activated.

Hello I started a small claims case and on the form there is a very small space where you explain what happened that brought the situation to court. It says :If you need more space to add on with a separate piece of paper. I did and tried several times to shorten my explanation. I Had housing Authority and a friend try to help me make it shorter. They both said they could not see how I could make it shorter. It was just one of those things that has to be explained at length. I added the additional; page to the forms that gets filed. I went to a free Small Claims Clinic that advised me what to do. They told me as well as the small claims Clerk did, that If I had any additional; documents to be sure to bring three copies on my court day. One for me one for the defendant and one for the Judge. So when I get to court there are so many cases, that the court started shuffling cases to other court rooms. The first several cases were taking extra long because everyone of them had to have interrupters, on one side or the other. The judge was clearly not being very patient. So sure enough at the last minute my case gets transferred to another court room and different Judge . I am worried because are two Judges going to take the time to read my additional page's. The new judge in the new court room is clearly put out for having to hear these two cases at 3:30 in the afternoon and the one other case that got transferred along with mine goes first and needs an interpreter. My case goes last and the Judge never really understood what was going on. He also never read my explanation, because he thought it was a letter I wrote to him without giving a copy to the defendant. Which was not true I had a copy with me to give to the defendant in case he wanted me to but it was merely the exclamation not an "additional letter to the Judge" The defendant lied several times and I lost before I was ever able to explain to judge what the situation was really about. Basically the judge decided against me before he had a clue what was really going on. I can not appeal because Plaintiffs are not allowed to appeal. What about when the Judge did not ever get it. And was mixed up regarding additional page's for explanation that he admitted he did not read, because he thought the defendant did not get a copy. What can I do If anything?

If you have kept records of the calls made, plus the fact you have a job which you could lose, this may go in your favour. However, the court won't take a breach in your community service order lightly.

My husband committed and offence in 2004 and was sentenced to 12 months in 2009 after he had initially fled the country before sentencing. Upon release on probation in 2010, he left the country again but now wants to return to the Uk. He has committed no offence since release. I want to know whether he would face another sentence for being unlawfully at large. I also want to know if he faces just the 28 days standard recall or likely to spend the 5 months licence he had outstanding back behind bars. I can't predict what will happen in his case as much is dependent upon the level of harassment in the lead up to his arrest and the distress the victim suffered as a result. According to the CPS, there must be evidence to prove the conduct was targeted at an individual, and was calculated to alarm or cause him/her distress, and was oppressive and unreasonable. The court will be more lenient if it is his first offence. However, as previously specified, this depends on the level of the crime committed.

My boyfriend got a caution for Harssmwnt last year, then s verbal warning in March. He didn't contact this person until July but only to say sorry. He's not been to court and as got to see a probation officer and wait for his sentencing. His only scrap with the law was last year with that caution yet he's been told he can go to prison for this by his solicitor, he's never threatened his ex and it was only to say sorry. What will happen to him and will he be able to use that's he's never been in trouble with the law prior to all this?

Hi, i was sentenced in may 2015 for fraud and got 200 hours of unpaid work and repay all the money back, did not get a suspended sentence, but it was my birthday on first week of august so i told the area manager of probation i would not be attending for 1-2 weeks as im going away on a trip and he said that would be fine but now my probation officer has sent me a letter i have missed one day and i am returning to court. what can the outcome be if i go back to court? i have done 120 hours so i have left 80 hours

Instead of letting it ride, he should have contacted the community service supervisor or his probation officer as soon as he began having problems organising his community service. If the case has gone back to court, the judge will make a decision which may mean he could be sent back to prison. I'm afraid we can't advise whether this would be the case, as we can't predict what the judge may decide. However, if he has kept records of the calls made and the reasons why he could not resolve the issue, plus the fact he has a job which he could lose, may go in his favour.

They kept transferring him to other people to ring for few weeks and finally yesterday he spoken to someone and they said his file went back to court....so he can be arrested now.....? Is this fair that for last month he tried to get this sorted but no one said anything until yesterday ....also he can't get arrested as he will loose his job!!! What he can do? hi my son was given a sentence plan the judge said there was a clear guidance as to what is expected of those responsible for compiling the sentence plan and to make sure my son gets the help he needed to stop him reoffending when he is released on licence and if it dosent get put into place in prison then it should be on his immediate release ,my sons probation officer was responsible for setting the plan in place, my son was released last august and his probation officer failed despite several requests from my son and myself to give my son the plan he was supposed to have on his release, he was responsible for it. the probation officer refused to abide by the court and clearly was unable or refused to set my sons plan into action.. sadly my son reoffended and was recalled to prison and the very same probation officer pushed for the longest time ,standard recall. now my son is pushed back into prison with the same problems and no help, I find this probation officer failed my son and I do believe if he got the help he was supposed to then the outcome could have been very different for my son. what do I do to make sure my son does not have this useless probation officer in charge of him when he is released. my son deserves the chance to change his life around and with the help he was supposed to get could have been it , this was my sons 1st offence ,I hope it is his last. anna

He is due to go back to court in August, and has just been told they have found all the correct evidence. My partner was sentenced to 150 community service for a minimum harassment without violence offence. I was also charged but this was withdrawn at the magistrate's court as he pleaded guilty and there was no evidence against me. He was ordered to pay compensation however he is unemployed and not in receipt of benefits - I support him financially. How can it be fair that I as a co-defendant was exonerated but am liable for his fines- in effect, being punished for a crime I did not commit?

My partner has 4 weeks left of a 7 month licence and since week one the probation services have repeatedly failed to follow up basic requests, or have had to be prompted several times until criticized. They insisted that he had a 10pm curfew that he argued against as it was not in his licence terms, they did not check and my partner proved it with his own paperwork fuming that he had missed seeing the new year in with family and having adhered to 5 weeks of an unnecessary curfew. Also they assured us that his benefits claim was on the system, only to find out after dental treatment that he was not and a nice bill of £118 was delivered to our door, the expert that re did the claim then put my partner on the wrong benefits throwing us into benefit turmoil for 5 weeks and resulting in us having to use the food banks on two occasions. probation have failed to write letters to the job centre and doctors as requested by ourselves and promised by them, resulting in no back dating of benefits and late medication for his behaviors. Now their excuse for not looking into past fines is because they have too many people to see, that tells me they can not handle their case loads and i have expressed that i would like to complain, i have never been abusive or violent, however i have criticized their lack of services and their recent response is that i am no longer allowed in the building or privy to information that my partner has requested i be involved with. i would like information on the complaints process as i do not believe that these constant errors are supportive to service users or their families and that they can contribute to an individual failing rather than succeeding in life.

Hi my husband been to court two time had two contact orders and one temporary order to see his children on last court order down time in contact centre then time out with kids then had one night every other weekend then moved to two nights contact every other week also had a cafcass monitoring order for a year as mother kept stopping contact the monitoring order was up in June and within 3 days the mother has stopped contact saying same things has she has done for last 5 years saying I am mentally messing with kids head and they don't want to see me I never had a problem with kids why here this all just started soon as cafcass monitoring order was up I am left to pay once again to go court she don't care what the judges say she's a mother that thinks she's a law to herself and can do what she likes with the children how about the father and most importantly the children's rights to see their father can anyone give me some advice

I went to my unpaid work meeting about 3/4 weeks ago and even though they told me I'd be contact within a week by phone and letter, I'm still yet to receive or hear anything. Is it my responsibility to chase them?

hi there im waiting for court after shoplifting were i was working. i been a bused to do and it was my manager told me to do, i couldnt truth any other managers to tell this so i been used so much from them. i was afraid to lose my job. i stay quite however they found on the cct me picking up cloth and the manager who told me to do came to the store when i CLOSE from the customers and told me to stay with him and his friend. anyway i told the police everything i didn't waste there time and mine, in 10 days im going back to the police from bail however i have got another job for my self and applied college to star in September. i never been criminal before and i have had hard life in my past, i been abused so much as a boy to man. what will happen to me now im very scare of prison im very vulnerable as i said my past i have been abused.

Hello, I need some advise please. My boyfriend for 4 years is on probation, he has 14 more months to go. I want to move forward in our relationship but because is on probation, he will not even talk about marriage. He told me to wait another year or so then we can get married. Due to his parol officer, he can not move, go on vacation etc. Is this true??

I haven't been able to go to either probation or community service because I have two kids and my wife is abusive, and I cannot leave them alone with my wife. I am currently on probation for a 6 month term I was given 20 hrs hours of community service no biggie but I was told to go to one place to do it an it no longer does it my po tells me he had me down for a different location so I call them in front of him an the phone is disconnected he gave me a p.o. box and a city but no exact address an told me it was up to me to find them an figure out the correct number on my own an if I didn't then it would revoke my sentence is there any way possible for me to complain or fix this so I can get my hours done properly?

my son is already on probation and attending communtiy service for the beating of his girlfriend he has been charged and arrested for the same thing again and is in court tomorrow does anyone know what will happen to him as i am at my wits end as this is a volatile relationship and they are as bad as one another please advise

@Nat - any courses should have been agreed in your ‘sentence plan’. How long you remain on licence depends on the length of your sentence, your age at conviction and conviction date. This information should be stated in your licence.

@JD - no it is up to you to really remind her of the order. Should she not adhere to it, then she will be in breach, in which case you would have to take it back to court in order to have the order enforced.

There has been a big abuse case..at a school my son reluctantly gave evidence...but very well police and barristers pleased with him.Many of the verdics were guilty against the perpetrators. My sons was not found guilty.The defense for the abusers tried to "destroy" his character in court.he has been vulnerable and was at a special school,he is adopted.He is black and there wasn't one black juror.The police said he was their best witness..he was badly abused. They are to be sentenced soon.Can we appeal against the jury's decision? The judge praised my son even though a no guilt verdict was given

When my partnre and his wife divorced , the court ordered that she should make a financial settlement of 25% of the value of the house at current market prices, when she was 60. She will turn 60 this year. How is the order implememnted? Does my partner have to do anything or does the court write to her to remind her of her obligation. The court also ordered that her legal aid should be settled at the same time from her share of the house.

My husband has been to magistrates court and found guilty of assaulting myself and a police officer. This did not happen and he did not have a solicitor as she said it was getting ajourned so did not go. His solicitor is not happy and said this should have not gone ahead. So she is taking it for a retrial to crown court. My husband has to answer to probation tomorrow and he is back to court on Tuesday for sentencing. What does this probation thing etc mean ? I'm so worried and need some advice.

My partner is in prision for rape. He had sex with his wife and she cried rape because her boyfriend Came home early. He is due for release next year on license. We are both hopping he can come home as I am disabled but his probation officer has said she things I am at risk from him. I have been with him for a while now and not once has he shown anything but love towards me. Can they make him stay away if so how long would he be in a bail hostel .? Thank you for your help Taj

@Dottie - I think I would try to avoid making a citizens arrest - but you could inform the police if you became aware of where he was living. He will be on the police/probation radar, they won't let it go and the court can issue a warrant for his arrest for failure to comply with the court order. I hope this helps.

My son was assaulted by someone who was already doing Community Service for a similar offence, due to Police shifts, holidays including the Probation Officer being on holiday the Police where unable to visit him at his home address, or apprehend him at the place of his Community Service for nearly a month. His Mum is claiming she has no idea of where he is, though he has been seen in the area by myself, and other members of my family. What happens next ? Will the fact that he has not attended his Community Service or kept any of his Probation Officers appointments be taken into any account? And if we find him can we make a citizens arrest?

I'm due in court at the end of this month. 3 weeks basically. The charge is burgulary, my codefendent has been remanded as he was on tag at the time the offence was committed. He's on his third strike for burgulary. Where as I have only two previous convictions (neither include burgulary). What's the odds of me getting a fine & community service, tag etc.. Which I personally would much rather prefer than a custodial punishment. I'm currently working full time and due to start a course next month. The case is to conclude in a crown court.

My dad was sentenced to 7years in 2011 and ia now released and doing 3 and a half years on lisence and he has had his lisence agreement and signed it and everything but he has trouble reading so i do it all and i was just wondering can his probabtion officer and police just add another condition on for visiting family or does it have to be a judge? Because he has not agreed or signed it can this be done??

My partner was sentenced to 14 mths suspended for two years for violent disorder. He was also given 200 hrs community service. He was breached last year for not attending due to the break up with his ex partner..He was fined and given additional hours. Recently he had an illness that prevented him for serving his community service. He sent in sick notes to probation. They say they are missing some of the sick notes and that he didnt inform them of his new address...He did, I was there when he rang them to tell them. He had ony 87 hrs left to complete. We went to court 3 weeks ago and showed the medical evidence. The judge said that if it hadnt been for this evidence he would have sent him to prison and said that he needs to go back to court in three weeks while they gather more evidence. He also told him to do as many hours as he can in the meantime..He has done another 18 hours in the three weeks (he works full time) and we are due to go back tomorrow..Im worried at the outcome..What do you think is likely to happen

Hi I am the wife of someone in prison that has had a slanderous allegation made about me by the probation service, the complaint was upheld,but the local boss of probation service is refusing to meet with me,the ombudsman cannot touch the complaint as im not the prisoner.I am only his wife!!! Any ideas anyone???

@Lynn - it depends on what they were not caught doing. If they have breached probation and committed a crime then yes. If they have breached probation for something relatively insignificant and it has gone unseen then possibly nothing would happen, as evidence would be needed.

My partner was arrested for TWOC, drink driving with no insurance and causing some damage to some fencing surrounding a property also he is a provisional driver. He went to magistrates court who took his license. They have sent for him to have a meeting with a probation officer and then back to court that day. What do you think will happen?

Hi, I have recently been in court regarding a civil case relating to an RTA that never happened. The guy has changed his statement regarding 'swerving to avoid' to 'being hit from behind' by me on a night when I was charged with drink driving and leaving scene after myself crashing my car. The solicitors firm are known for this kind of ambulance chasing strategy but have yet again won as the judge advised I 'stick to the facts' regarding the claim not being served at my current address. The insurance are liable to pay but are intent on trying to get over £20,000 from me in installments, I am not willing to pay as I know it is a pack of lies and to anyone reading it is obvious. When in court I represented myself and was torn apart by 3 QCs. How can I complain about this and get it investigated as it is fraud plain and simple! I was going to contact the legal ombudsman but it seems they only deal with 'Your' solicitor. Advice needed! Thanks in advance!

@Cc - It really depends upon your prison sentence, so for instance determinate sentenced prisoners, serving sentences of 12 months or more, where the offence was committed after 4 April, 2005 will be on licence from release until the end of their sentence, whereas those with a life sentence will be on licence for life. You don't give much information on the situation regarding whether there are children etc, or how much money you have invested, or what share of the mortgage she has. But if you are going to take it to court then you need to back up your reasons why you want her to leave.

I recently took out an occupation order against my partner after she changed the locks illegally to lock me out of my home. After tens months it finally got to court and judge didnot grant the order but extended it to two years after my partner told a pack of lies about me. I asked to seek leave to appeal but this was refused out of hand I feel I have been given a very raw deal do I have any redress ?.

I pleaded guilty to be fit fraud as could not afford to go to trial as dont qualify for legal aid. I was given 100 hours unpaid work and that was all. My question is will I have a criminal record now and do I need to tell my employer as I work with kids? Thnaks

@RL - I still think just to be on the safe side, you should double check with the DBH helpline so they can tell you directly whether or whether or not your offence is on your record or has been removed and ask them to reassure you that it wont go against you.

@eddie - take this straight back to court as this is a breach of a court order. The court does not take kindly to orders being breached. Every time she does it you need to return it to court. Good luck. You need this order to be enforced!

@char - If you are based in the UK, I suggest you contact the Offenders Families helpline who may be able to give you some advice on fighting your case (as yes, it is worth fighting). However, if you are based in the US, I can't advise as you will have a different systems than in the UK, apart from saying it is worth fighting your case in order to have a clean record.

Hello I'm on probation right now and my p.o got a promotion and I got assigned a new p.o about 6 months ago and its almost my year date that I got this order. Well when my p.o got a promotion and assigned me a new p.o she took 3 weeks to complete my file transfer so as I was seeing my new p.o my old one breeched me on not appearing for 3 weeks and I left a message about my where about the day I hhad a meeting and my family said she called back but didn't say more then that and then she went on vacation so its not on record I seen my p.o because my old one didn't finish her job and transfer my complete file and went on vacation. So my question is why is it she gave me two breeches of not seeing her or complying with my order and reporting to a officer when I did and the only time I didn't was 3 days and I was scared of what she would say to me about not checking in for 3 days . So is it fair they are asking 6 months for my first breech or should I keep fighting it

Hi my partner received two yrs jail on the 18th of Dec for doing TICS anyway I know he will only do a yr but then he's been told that he will get out on tag in august but before he went inside he was on tag for 23wks will that all come off his sentence too.

@caz - it's very unlikely as the whole thing about home detention is that he is available at a specified address at certain times of the day and is contactable at that address. I don't imagine the service is transferable to Spain.

The british judicial system favours the criminal elements in society, where ever possible. As far as I can see it penalises the poor working classes as harshly as possible, even for minor misdemeanors whilst often showing compassion to other serious offenders involved in rape, murders or child molestation.

My boyfriend is in DUI court, and his probation officer wants me to move out of the apartment we lease together. Both of our names are on the lease. He's giving me a week. @Em - Home Detention Curfew, HDC, is available to prisoners with sentences between three months and four years. Prisoners on this scheme will be released between two weeks and four and a half months before their automatic release date, depending on the length of the sentence. Hi my son has recently received a 2 yr suspended sentence and ordered to do 200 hrs unpaid work and placed on probation for 12 months. He has received his date for his first appointment with a probation officer, because he works full time and the appointment is during his working hours does he have to comply? are the probation service duty bound to reschedule appointments around his work hours? @none It is possible, but dependent on the circumstances. In the first instance any move must be discussed with his probation officer and if the officer agrees then your partner can be set up with an officer local to his new address.

Hi I was given a suspended sentence of 18 for 2 years and ordered to attend probation and do unpaid work i was attending probation regularly and waiting for my unpaid work to be assigned when my probation worked left the firm i contacted them a number of times to get information as to when to go to probation as my times changed and they kept saying they will contact me via phone call or letter and they never did now I'm being told iv breached my suspended sentence conditions and am to attend court i don't know what to do i went to probation and they said they haven't got any record of my phone calls so iv breached. Is there anything I can do as iv just got my life together and a job and don't want to go to prison as i will loose everything iv worked so hard to do.

@Lee, if you're sentenced to 3 years with YOT or put on probation this will be while you are at home. There will be different conditions that you will have to meet and you will probably still be on a curfew depending on your crime and seriousness of it. You will have to meet with your probation officer on a regular basis and if YOT are involved this is to help you reduce your chances of re-offending.

Hi, my name is lee, it is my 1st offence and im on Tag and doing iss on my bale conditions, im getting told i can be out before christmas, then im getting told i might be doing 3 years with the YOT or Probation team, im obly 17 years old. I Want to go back to my family before christmas and ive attended all of my bale conditions and ive been in the room in my hostel for my curfew at 9 every night so will i be released after i plea guilty to court but ive got court again on december the 3rd to see whats going on, please give me advise about this please because im doing so good on my bale and i might be doing 3years with Yot or probation team? i wont be able to cope with that Thankyou

Ive been sentenced to 160 over 12month time hours of unpaid work ...Wich ive atend onli 40..Then i had to go back to mi country due mi father been diagnose with cancer...Didnt had the means to come back...Are they gonna put me in jail??Or is it posibile to hime more hours off unpaid work??I want to tuen miself in but im afraid they will sentence me...Can get an advice plsss..Thank you

My husband is in the prison from 8 months ago, he's sentenced is finished all ready,we want to apply for bail but the problem is the probation officer is not provide all those documents to my solicitor...we keep calling hem, sending letter but still nothing,please advice what to do!!! Thanks!!!!

My son is due to leave prison in eight weeks. He will have served his sentence, and he will be a free man. Does he still have to be involved with his Probation Officer? The Probation Officer is telling him that if he cannot provide an address of where he is going to live when he gets out, then he will go into a hostel with alcoholics and drug users. He has said that he wants to get a place with his girlfriend because they want to live together and start a fresh life together. But the probation officer is saying even that is not suitable. Can the Probation officer do this, why would probation still have control over him when he is now a free man.

the police in court cannot produce evidence to the traffic offence the officer files a fpn notice with mistakes falsified claims to be in one place and writes on fpn a different place and the outcome the driver gets fined and points and thats acceptable

have sentenced 2years by juduge in 5/12/2006 and served one year in prison.discharged in 5/12/2007. i was 16 years of age at that time.when i can apply the citizen-ship.

I GOT PROBATION FOR 18 MONTHS IN 2001 , ONLY DID 4 MONTHS THEN MOVED TO SPAIN AND DID NOT TELL MY PROBATION OFFICER , SO DID NOT FINISH MY PROBATION ,, IT WAS FOR BENEFIT FRAUD ,, NO EXCUSE I SHOULD OF FINISHED IT WANTED GET AWAY , DUE TO A BAD AND VIOLENT REALAITIONSHIP WHICH COURSE THIS PROBLEM IN THE FIRST PLACE ,, I WANT TO GO BACK TO UK TO WORK , SOMETHING HAS COME UP ON MY CRB CHECK , I WANT TO GIVE MYSELF IN WILL THERE BE A WARRANT FOR MY ARREST ,,, I AM SO SORRY FOR WHAT I HAVE DONE , AND I AM WILLING TO GO TO PRISON IF NEED SO ,,

I have recently been given a community order of 150 hours unpaid work, to be completed within a year. I am currently unemployed and I'm having trouble claiming benefits. I have no money. I need to get to a probation office in my local area, (which is Coventry) I'll struggle getting to Birmingham - the office I have been assigned to. I live miles away from Birmingham and my probation officer has refused to allow me to move. It is ridiculous. The only practical way of getting there is train, in which I cannot afford. I want to know if i can have my probation office changed, and where I stand legally with my probation officer, as she is forcing me to travel illegally (without a ticket). I face being in breech of my order by not attending, but I simply don't have the funds to get there.

Can his probabtion officer who comes sees him in prison have anything to do with helpin, or recommendin him to be home on tag for rest of his sentenced?

my bf got a prison sentence... i know he'll only serve half, or abit less then half.. but is there any hope that he might get oyt sooner? cause i heard once there in prison, its kinda up to the Governor when he goes home, obv on tag and stuff... :( jus want him hom sooner than later! Does anyone know?

I have apparently been given a curfew order for 12 weeks from a magistrates court even though I was not present at trial or sentencing and nor have I had a probation assessment or agreed to such an order. Is it legal?

If a judge suggests the offender should send his daughter a letter each month, and can also send a gift, but the probation officer states the offender can only send 1 letter or he will be in breach of his licence restrictions and will be recalled to prison. Does the probation officer have more power than the judge. Can the probation officer overrule the judge's decision?
