Offenders sentenced to determinate sentences of imprisonment for more than three months but less than four years may be entitled to release on Home Detention Curfew. This is an initiative that allows an offender to be released from custody up to 120 days early as long as they abide by strict conditions on licence. It was designed to allow an offender to get used to being back in the community and thus allow for an easier transition from prison to home life. Home Detention Curfew is as it sounds; the offender is allowed to go home but must ensure that they are inside the house for specified periods (usually during the night.) The requirements of Home Detention Curfew are that the offender must stay within the four walls of the property during the hours of the curfew, which means that it is not acceptable to go into the garden (e.g. to smoke, or to join in a barbeque).

How Does an Offender get Home Detention Curfew?

Not all prisoners are eligible for home detention curfew. Some will be excluded by virtue of the nature of their offence, in which case they may be classed as ‘presumed unsuitable’ (and will not get HDC unless there are exceptional circumstances and the governor agrees to release on HDC) and others will not be eligible because their sentences are either too long or too short. If not automatically excluded from the home detention curfew scheme, prisoners are assessed before their HDC date, i.e. the date upon which they would get HDC if they were assessed as suitable for it.

Offenders who are not excluded from the scheme will be assessed by the probation service to find out whether they can be released on HDC. This includes passing a ‘risk assessment’ and ensuring that a home circumstances check is carried out satisfactorily (the place where the offender will live while on HDC.)

If an offender is refused HDC, they can appeal the decision by submitting a complaint form to the Governor, setting out the reasons why they think the decision is wrong.

Practical Elements of HDC

If an offender is released on home detention curfew, they will need to agree in writing to the licence conditions. These are usually to stay within an agreed address between 7am and 7pm every day. The property to which they are ‘tagged’ can either be their home address, a hostel or another approved premises.

The curfew is enforced by way of an electronic monitoring device that is installed at the offender’s pre-approved address. The offender is monitored by way of a ‘tag’ around their ankle.

What Happens if an Offender is Recalled?

If an offender does not comply with their curfew, the monitoring system will alert the contracting company that provides the tagging system and the offender may be recalled to prison. If this happens, they may not be re-released until their automatic release date (usually at the half-way point during their sentence.) If an offender is recalled to prison for breaching their tag due to circumstances that were not within their control (e.g. not being able to remain at the curfew address anymore) they may be able to apply for a further review of HDC once an alternative address is found (and subject to that address being deemed suitable.)

My son was refused his tag,he put in an appeal straight away,the probation are backing him and have approved our home address,he,s classed as an enhanced prisoner and done everything in prison that was expected of him,his tag date is in 6 days time, hasn,t heard anything about his appeal or if he,s getting out or not,nobody is telling him anything so he,s got no idea whats happening and nor do we,anybody help please.

Hi my son got taken to prison in October last year. Though fighting and arguing with girlfriend. He was on a breach so had to stay in till February and still did not get bail then. He went to court and got 2 years and 2 months. The solicitor said he would be out in a month because of the time he had already done. When he went for tag they said he could not have it because of a breach in 2019 because l was kicked out but he did contact them straight away. Hi I need some advice my partner as put in for his tag at mine. this is the 6th time my son has been sent to prison in the last 12 mths for breaching a restraining order on myself due to his drug habit? hes saying he may get released on tag at a bail address but as alwaz wherevlways whenever hes released he has nowhere to go and turns up at my address where i accomodate him for a week then the same scenario "drugs drink mental abuse etc etc but if he is lucky to get a b abd b etc through council it is always where alcoholics and drug abuses are? not saying he even wants to change but?????????? he again has no ddress to go to so the scenario starts again and he will b back within 2 weeks max??????

Hi Keira.
Going on recent experience he should do between 10 / 11 months inside providing hes a good boy , he'll get his tag first day of release after clocking on with probation, he should apply for the curfew as soon as he gets settled inside to give them time to process the application . and make a home visit before his release to make sure the address is suitable ( doesnt always happen )

My son was released from prison on HDC tag but a few weeks afore his tag finished there was a incident at there address where he didn’t feel comfortable staying so left we rang police and made a statement and he went to a different address then 5 days afore his tag was to be removed they recalled him but that was 4 weeks ago and just arrested him what will happen now he has been took back to local prison I’m really worried as had a lot of problems in there last time

Hi, a friend of mine was sentenced to 28 months, the max he has to serve us 14 but his P.O. has informed us that’s he’s eligible for tag from the 7th April, which is 4 months early- however while in there has has heard from others that with the new Gps tag system some may be eligible for release 6 months early rather than 4- I haven’t found much info on this matter online is this true?

if your not happy with a person being tagged at your address, call the tag people they will come and remove it, it's called a withdrawal of consent, as the homeowner you do not have to have it

My ex boyfriend is currently in jail, the crime happened in Wales and he got arrested in Wales, and his court hearing was over in Wales. however shortly after he moved to my home town out of Wales nd has been living here in his own flat on his own up until when he had court on Monday 29th July, he got 15 months and allowed out on tag after serving half. Hi, my husband was sentenced to 18 weeks for drink driving and was eligible for tag on 26th July. He hasn’t been given the full paper work from the prison yet but has been given a probation officer which has said that he has to wait for the documents from the prison to be able to do anything. Hi just wanted a bit of advice, my partner is currently in prison for a driving offence and is eligible for HDC his date for this is 19.10.18 probation have passed him and there paper work is with the governor. Hi my partner has been given his tag papers and filled them in. What's his chances to get out on hdc. He's been charged for domestic assault against and ex partner and was sentenced for it. He's applied for a tag at his friends address and has had good behaviour since being in prison and has been told he has passed the first 3 stages of the process. He couldn't get tagged here due to my son being here and sw dragging there heels to do as risk assessment. He has never been violent to me and hasn't offended in a year after that happened. My anxiety and through the roof wondering what's happening and scared he won't get out I'm not coping out here on my own. He's trying to change his life around and being out and having support would help

HDC is not an entitlement and can only be granted subject to prisoners meeting the eligibility criteria and passing a risk assessment. Prisoners serving sentences of between three months and four years can be considered for the scheme which can grant early release between two weeks and 135 days earlier than the half way point of the sentence. You can see more via whichHowever, if your husband is being deported, he would be considered as having a high risk of absconding. He would be more likely to be considered for an early removal scheme and not HDC.

Hello I would just like to ask what's next to do well my partner was sentence for 8 months for affray on the 3rd of November he is a category c at the mo and we are trying to get the category down to a D. I have had a phone call from his probation officer to discuss his HDC order but that's it no home check yet can someone tell me what this means please as I am a bipolar and finding thing really hard and we also have 5 kids with special-needs so please can someone help me

Hi, my partner got sentanced to 2 years 2 months in October for GBH, he was very drunk and didn’t know what he was doing :( with him pleading guilty he has had a 3rd nocked off and the judge has nocked the 2 months off, on good behaviour will he be able to come out early? He’s been told he might be eligible for the HTC and get out in June is this right?

hello i have a partner currently serving 18 month (halved) his due out 29th january2018 I'm due to give birth 13th january we have 4 children already iv been in contact with offender manager she has cleared things her end and happy for him to reseave tag however I no it's down to govner to make final decision im I'm on edge and trying not to pin hopes on this option but really need him home he has a few make ego discrepancy on his report but all the omu say is its 50/50 how long is the whole process to no where we stand as couple and a family

Hi my boyfriend got sentenced in the 20th August 2017, he got sentenced to 8 months but serving half of that, he's been told he's eligible for tag and release date is 16th October, very soon im just wondering how long does this whole prodecure actually go on for? I've contacted probation officer and he's currently waiting for paper work too come too our property too check it out. Me and his probation officer are staying in contact pretty much everyday too see if either of us have heard anything, does anyone know how long this whole prodecure takes as he's getting so annoyed with no one even telling him anything in prison, so keeps saying someone's coming too see you as soon as possible.

Your husband can appeal against any refusal of tag if he does not believe the refusal reasons are valid. The refusal reasons being; he presents an unacceptable risk to the victim or to members of the public, he has a pattern of offending which indicates a likelihood of re-offending during the Home Detention Curfew period. Or, there is a likelihood of failure to comply with the conditions of the curfew, there is a lack of suitable accommodation for HDC and/or the potential curfew would be too short.

Hi , my husband was sentenced to a money laundry offence for 42 months last year in April . Half is sentence will be over January next year 2018 however he applied for the HTC for release snd be on the tag from now until the finish of he's sentence in Jan . The tag realise date was meant to be 13 sept but it was refused . The reason given was that the home circumstances does not support it . At first we didn't know what that meant and soon found out as my husband and I have history of domestic violence at the address ( where I live at the mo too ) . On my statements to the police at the time , it said that he hit me etc etc . Based on that he was refused . He wrote a letter to appeal , had an interview with the governor and again it was rejected . The thing is I really want him back / we have two children and I want to know if there is any way he can get the tag ? What about if he used a different addresss ? Another family member and stayed there , would the prison authorise it ? Pls someone help me I'm so lost

Hi I am currently out on hdc I was sentenced due to a breakdown due to my working life affected my physical and mental health caused issues in which I commuted my offences I am currently being sent to see a physiologist to test for bi polar and sckitzapheria I went back my parents lasted a week I am now at my brothers I can't be around the same people for periods of time I'm struggling to control my anger etc which my doctor knows how serious my mental state is at the moment and how it's making me feel I was just wondering as there looks to be no chance of getting my own place soon weather if I went back to court given I've done more than half my sentence and giving my mental state would a court consider changing the remainder of my sentence on tag to community service which would give me the option of staying between places because being round one person for some period of time is seriously offering my mental state and consider as well as my doctor does of what and how I feel I want to act which could cause other's harm any advice please I'm lost with all of this

Hi my boyfriend has been sentenced and has to do 21 month for abh section 47. He has been given an eligible tag date for October. It was domestic related so I am wondering weather he is likely to get tag. He has never been done for domestic before although he has had an assault 7 years ago in 2010. He was given tag for that which he never breached. This is his first ever sentence and first time in prison. I want him home asap but the domestic happened at our home adress. Nothing like this has ever happened before and he was very drunk. Do you think he is likely to get tag? Is there any way I can help, by speaking to probation myself?

Hello ive spend hours and hours looking all over the interent reguarding hdc. My other haff got 16 months. Half with good behaviour. Which he has be has been. Was in education and now working full time. He has applied for hdc but i really dont know if it will be granted for not? He is in for theft and has been well behaved inside , but he is at high risk of reaffending. He has a breach from 2010, that is 7 years ago! Does that really make a difference? Just really want to know your opinion and if you think its likely to be granted. The residence hed be coming out too wont be an issue as i know what the criteria holds.

I'm on tag at the moment as I'm awaiting trial for an assault. Iv been moved out the area to my dads and i have to be in by 7pm. They let me attend anger management on a Thursday and let me stay out until 10 as it takes time to get home. I'm not aloud into the previous area until after my trial. I'm also on bail. Iv got family in Leicester which is miles from where the area I'm banned from I was wondering would they let me stay there on Christmas Day if I asked either my probation officer or my solicitor or would I have to be back for 7 as usual?

My son applied for HDC but was told he couldnt get it as he had less than 14 days left on his sentence, however when he did apply he did have that but it seems the application was delayed. He has been given an extra 14 days sentence due to disregarding a direct an order so can he reapply for HDC again. Thank you for any hep you can give on this

If your partner has a history of violence, his risk to other people (especially children) will be assessed. If so, social services would do an assessment regarding any risk to your child.

My partners currently in prison, he's had a tag date for April 16th 2017, but other prisoners have told him that he may not get tagged to our home as our 1 year old daughter lives here. It's really worrying me now as if he gets out on tag I would love for him to be home where he belongs. Has anyone experienced this?

@ann - HMPS are a law unto themselves - they'll decide when and if your husband comes out when and if they decide. They don't try to make life easy for inmates, in fact it's the reverse! :I

My partner is currently serving 8 months in prison. He is being assessed for HDC, home probation has recommended it, his elegibility fate is Wednesday but we haven't heard anything. He has breached HDC 10 years ago and was recalled. I know that this would normally make you exempt from being eligible but they have assessed him and home probation have recommended it so does that mean it's looking like he will get it?

My husband has been sentenced for 8 months and it's his first time so he was in notification slip from the prison that he is eligible for Hdc and then a week after he was given an application forum to fill in so he did that an gave it in and in two weeks time its his eligible hdc date so will he be release on that date or not ?

A friend of mine is currently on HDC and additional requirements are that she can not consume alcohol. She wants to attend mutual aid AA/NA meetings. There is one afternoon meeting that she attends, however all other meetings are in the evening. One in particular would be of benefit as it is a women's only meeting. The meetings generally finish about 9.30pm and therefore she would get home for 10.00pm. It is suggested that she goes to 2 evening meetings as well as the afternoon one. Can the curfew be changed so as to allow her to go to the meetings. If so how would she go about changing the HDC curfew times for the 2 meetings.

@Faye - maybe the HMPS didn't have it on his immediate record so while he was initially eligible for a HDC tag further investigation brought up his previous breach. Prison is prison - you can't complain or make requests.

Hi my fiancé has been sentenced to 3 and a half years he was eligible for his HDC he breached a tag 10 years ago, They've refused it because of this. But it was ten years ago they knew he had breached it this long ago so why did they say he was eligible and make him fill the paperwork out if they knew he wouldn't be accepted we have a child together who was looking forward to having him home for xmas, Is there anything we can do? He's getting fed up in there now and said he wants to go back to his old prison to do the rest of his sentence but where he is now is an open jail?

We cannot comment on whether or not it is right or wrong that your husband will or will not be allowed release to your home, that is up to the board of governers to decide, based on the information they hold. Being released on HDC allows the prisoner to reintegrate into the community, rebuild family ties and all decisions will be made in his best interests in order to help prevent reoffending, You can call the Offenders' Families helpline if you need further advice.

My husband is up for realse on tag January 2017, he's inside for robbery.
He's now been told that he may not be able to come home to me and the kids due to the police being called to our home last year this was because we had a argument ( which everyone does at some point) he wanted told talk which I didn't as 1 it was 3 am, 2 I had 5 kids asleep plus he was under the influence of drink and drugs, I just wanted him to leave me alone, the police was called they didn't arrest him in fact they didn't tell him to leave they let him sleep in his bothers car right outside on our drive on my land I had the keys to the car I may add. But they've told him now as this happened he probably won't be allowed back due to it be domestic violence there was none and never has been. He does have mental health issues, he's done everything he should in prison all the courses etc they said.so why are they telling him this. It's not fair on my children as they don't deserve this and there expecting him home not long after Xmas?

@Anna - the HMPS would have told him if he was eligible for early release. But usually it's a straight 'no' if they have a four year sentence (his other charges push him over the four year limit).

Hi my kids dad received 30 month sentence on 16th Dec 2015. He has had his decision for tag knocked back based on the grounds that prison say he can't go back to his partners address as they argue and have had police there before. He said he has put in for it again this time at her mothers address still in the same town as her. My son got 18months so will serve 9months for Affray and Possesion of Offensive Weapon Probation within the prison are saying he won't get HDC when this is his first offence, Govenor told him he would be eligible for HDC in December 2016. Is this right or wrong?

Hi, was wondering if anybody could help me. My husband is serving 14months due to a driving charge. From what I understand he has been given a HDC Form for early release on tag in September. But I have not heard from a probation officer in relation to the home visit as I am he's first point of contact. He is also unable to get in reach with hrs probation officer? Would anyone know how I can get in contact with them. As recently he has been located in a diffrent prison. I am worried they have forgotten about him. Many thanks!

Unfortunately, we are not party to why such decisions are made. As a rule the only times someone may be permitted to extend their curfew terms is for a wedding or funeral of a close relative ( to attend the service only), an interview for a job, a medical emergency, or to act as a witness in court.

I am currently on HDC curfew having been released from prison on the 27th April 2016. I have put a request into the prison to extend my curfew over a full weekend for a wedding as it is not local to me. The prison have rejected this request. However, I see other offenders going on holiday on tag, I also know an inmate who has had his tag extended for a weekend away in London. So, I am struggling to comprehend why there is such a lack of consistency. I have appealed the decision by writing a letter to the Governor, I have had a response rejecting the request on social grounds? Is there anything else I can do to try and get my curfew extended?

If the prisoner is eligible for a Home Detention Curfew then risk assessments will normally begin around ten weeks before the start of the curfew date (where time allows). The only thing the prisoner should have to do is complete a form detailing the proposed address they wish to be curfewed to - see Offenders' Families link here for more information.

Hi please can I get some advice, my husband has been sentenced 4 years for a csa and hmrc. He will be doing 2 years. I'm 20 weeks pregnant and due in November. He's been told he's most likely to be enhanced in 2-3 months as he's a very harmless, easy going no trouble guy. Is there any chance or rule which he can use to come to the baby's birth? Is there such a thing and do they allow this? If so what's the process please? We already have 2 children under 8.

My partner applied for Hdc 10 weeks ago. All assessments have been done and he was told he will be told 6 weeks before release date if he can come out. Monday 4th July is the date they told him he may be released if the governor gives it to him. We are now 5 days away from the 4th and he had still not been given an answer. Could they release him without any notice? Is there anyone I can contact and ask what's happening ?

So he can move there on tag. I wanted to know will the probation service ask my landlord or estate agents? As I don't want them to be put off with us living there if they know he is on tag. Hi there

Friend was put on tag for an offence which was suspected of touching a weapon. They have been on tag for almost 6 months now. Forensics are back and no prints, and mixed DNA therefor can not determine when person touched the weapon in question so the prosecution can not use this in evidence.
Can they apply to get this removed? If so what is the process as still has to wait another 2 months before court appearance. Thanks

Automatic deportation applies where someone, other than a British citizen, has been convicted of a criminal offence in the UK and is sentenced to imprisonment for a period of 12 months or more for the offence. It applies whether or not the person spends or will spend 12 months or more in prison, provided the sentence imposed was for 12 months or more. Therefore, a person sentenced to 12 months imprisonment, who can normally be expected to be released after spending no less than six months in prison, will still face automatic deportation. If a person is convicted of more than one offence, automatic deportation will only apply if he or she receives a prison sentence of at least 12 months specific to one of the offences. It does not, therefore, apply where someone is sentenced to two or more periods of imprisonment of less than 12 months each but where (because he or she is ordered to serve the sentences consecutively) the total period of imprisonment is more than 12 months. You can see this information via whichIf your partner faces automatic deportation then I'm afraid there is little you can do as he will also be subjected to a mandatory re-entry ban into the UK of 10 year and/or longer. If your patner has not been sentenced to 12 months in prison as outlined above, and is still sent to a detention centre, then you would have to seek legal advice regarding the reasons why.

His solicitor is doing it but taking her time is there a time limit on an appeal ? He was refused almost a month ago, should he make the appeal himself from inside as well as the solicitor?

According to G4S 'Yes, the SPS would always encourage this to make constructive use of your time. However if your working hours interfere with your HDC curfew times, you may be able to change your curfew times to suit your employment. A headed letter from your employer with a start date, working dates and hours will be required to be sent by post to the prison. You should note that this information may be confirmed with the employer. If approved, the relevant manager will agree the new hours. '

hi my son is on home electronic tag if that's the right word he as had it on for two weeks and does not come off for another three months but his problem is he works in the oil fields and been offered a job off shore he also has a £500 pound fine to pay before the end of may. in order to do this he needs the tag removing to work and pay this fine in order to get his life back on track but no one seems to know who or how to sort this problem out even his probation officer is not sure how to approach this problem thanks all advice will be welcome.

If prisoners are not liable to be deported, are not an illegal immigrant and the case has not been filed under the Immigration and Asylum Act, then yes they may be eligible to be given a HDC tag. The decision regarding whether he will be given one will be made on the basis of how likely he is to abscond and how he has complied with immigration conditions so far.

hi i have been on bail for 2 years awaiting my court date, i have been given 2 different dates in that time but it keeps getting put off.
i have been on a doorstep curfew for the whole time and have had police knocking every night to make sure im there..
so i told my solicitor and he managed to get me put on tag until my court date just to stop the knocking..
but i would quite like to have my life back, socialise ect

Hi, my dad has been sentenced for 20 months. He's in prison now he's only been there for 2 weeks now, because he's got Swedish passport we been told he will be deported back to Sweden after he finish his sentence. I'm not sure if this true or not. This info wasn't from a reliable source. How can I find out what will happen after he finish he's sentence either if he'll be deported back to Sweden or not?? Also he might be eligible for HDC in Sept Oct and if he is how will we find out and when? And if this is true that he will be deported back to Sweden will he first finish serving HDC then get deported back or will they just deport him back straight from prison??

Rew your husband can apply for tag he will be eligible for the application process and it will be passed on to a probation officer for the assessments and the final decision lies with the guvnor my partner was given 6 moths do 3 and was told he was eligible but then 24 hours or arriving in custody the computer said he is not eligible due to his offence which he has not been trialed fair for either and when he wanted to put in a complaints due to his circumstances of me being heavily pregnant and having to work 14 hour shifts to pay everything he was told that if he complained he would be took off the "list" of people next to be released when the prison gets over crowded which is a load of crap but your husband needs to put in his wing app form to see probation in the prison and get the bowl Rowling good luck with it all

We thought he may get early release with tag as first time in prison.
He got in trouble years ago and breached a tag but that was when he was under 18.
Will that go against him now his an adult?
He has full time job waiting for him a lovely home with 2 children waiting for him

As specified in the article, if an offender is refused HDC, they can appeal the decision by submitting a complaint form to the Governor, setting out the reasons why they think the decision is wrong. He can appeal through the Requests and Complaints Procedure or through his solicitor.

I'm on hdc and have been on hdc from early December and was given to me at cat d an did 2 months in open conditions but no laydown period. Now I want to get married on Valentine's Day! They not allowing me to get married and saying its a social thing. I am doing 7am to 7pm an my Muslim nikaah ceremony is at 6:30 an will last till 9pm. I asked them to lift curfew from 7pm till 11pm an the governor of hdc OMU dept at Brixton hmp have said no and got solicitors to interact and have had probation involved an they are still being heartless but yet they allow ppl to attend other immediate families wedding or funeral. Hi, my partner got sentenced or 12 months in December for gbh without any previous convictions, good character, nice person just a very silly mistake. He's had a letter back today denying his tag for match with Jo relevant reasoning as he's done nothing but behave whilst being there, working in the kitchen and generally keeping his head down. they even moved his from Cardiff to USK open prison as he doesn't act as a threat. He's now appealing but what can I actually do to help? Is there anyway if I contact his solicitor and get character references from his employer etc it would help? I'm furious as to how this has been handled from day one as it got dragged on for two years before he even got sentence without any solid evidence against him and now I'm stepping in because he should've atleast been granted HDC if not at all been sentenced in the first place!

My partner is due to be released in July and has been told, preliminary that he's eligible for a 4 month HDC. When he went away, I financially had to move into much smaller accommodation with my children (he has two from previous relationship who sadly had to leave me and move back in with their mother) This means that when he comes out, we have decided he will move in with his brother, untill we can save for a bigger house again and all be back together at the same time (to make it fair and an easier adjustment for the children) ...but my worry is, that may be some time and that means as his brother lives in a small flat, it wouldn't be suitable for the children to go over to stay, and obviously the terms of the HDC mean he can only stay there. Is there anyway they will consider being curfewed to two properties, so he can still spend time with his children overnight at mine occasionally? Would that come under 'special considerations' at all? Kind regards, D x

My father was charged with fraud in Jan 2015. He pleaded guilty in Oct 2015 prior to trial and was sentenced to 4 years 9 months in Jan 2016.

Trying to digest the new rules we assume as his sentence over 4 years he is not eligible for HDC but have also read that you are only statutorily excluded from consideration for HDC if your sentence is governed by the Criminal Justice Act 2003 (CJA 2003) and any of the provisions of section 246(4) apply if your sentence is longer than 4 years and with that in mind, he can appeal to the governor for HDC.

During 2015 my father also suffered a fall which resulted in him breaking his heels and was on therapy for this prior to being jailed. Without this therapy there is a high chance he will be disabled when released?

Is there still the option to apply for HDC with the new rules which have come into place?

my partner got released on tag october ending febuary the tag box got knocked whilst we were in bed resulting to the phone being off the hook for 6 hours they are trying to say then resulting to him being missing for 6 hours which is not true as he was with me the whole time for it to then take 2 days for the police to come and recall him back to prison has this or anything like this happened to anyone else what i dont understand is why it had taken them 2 days to come for all they know he could have been on the run and they are giving him a 2 day head start i would have thought the police would have been there when there was somthing wrong with the machine and then they would have seen he was in bed wrongly he has been recalled back to prison and 3 days later still waiting for answers! the system is far wrong! can anyone help me with how i can take this further who to contact etc Would be a great help

My partner applied for tag it was due 1st of Jan but he's probation officer is taking forever he got everything he needed 5 weeks ago he's now saying he needs a form of the prison but can't get hold of the person he needs to speak to he didn't even no what prison he was in and he's looking at historical offences he made 14 years ago saying he keeps reoffending which he didn't how long do probation have after he's tag date to sort it and can you put a complaint in on a probation officer as all he ever says is he's busy help would be appreciated thanks

Your partner would have to pass a risk assessment, which includes a home circumstances assessment. The suitability of the address may go against him if if your address is known to the police. He would have to speak to his offending officer who will advise.

My husbands Hdc was approved and the day he was suppose to leave it was cancelled, can they do that and why, he has a flawless record in prison and all the checks were approved. Who can we complain to regarding this, they have no rights like animals. Also when the inspectors were in the prisons were working hard to show the inspectors they are a good prison, as soon as the inspectors left they were back to tricks. They should be ashamed to treat people inhumanly. Hope it happens to them one day. And it can!!!

If this is his first offence, and dependent upon his crime, he will be released when he has served 50% of his sentence.The remaining 50% will be served outside prison but will include the HDC tag and other licence restrictions. Here is some information which I hope is of some help to visitors to this site.

In August 2012 I was sentenced to 12 months custody, half of which would be served on probation. I had not been in trouble for a number of years so I was unfamiliar with the concept of HDC when it was suggested to me a few days after I arrived at Bedford prison.

Several days after applying I was informed that I had been refused for HDC due to a 'breach' of a probation order back in 1997. I was extremely disappointed as it would mean missing Christmas (release date 23 January 2013)

A few months passed by which time I had moved to a Catagory 'C' prison. I phoned my wife who informed me that a location probation officer had phoned to confirm that I was being assessed for HDC. Of course in view of what I had been initially told his came as quite a surprise.

Weeks passed, and I heard nothing. I put the whole exercise down to a communication cock up and the probation call was obviously made in some kind of error.

By now it was early December and I was focusing entirely on my release date in January. One morning while I was attending an education class I was called to see one of the governor. As I waited outside another inmate informed me that we were there for a 'HDC' interview. I was still convinced that it was all some kind of administrative error, and I would be told that I was not eligible for early release.

I was greeted by a governor and the prison probation officer. They made reference to my breach back in the 90's, but after a brief chat between themselves they informed me that I would be going home within 7 days on HDC! My daughter was having her first Birthday on 23 December, so not only would I be with her on that date, but also Christmas and New Year.

The bottom line is, ultimately the final decision on HDC is at the governor's discretion. Prisons are over crowded and under funded. They want you out of the door as soon as possible. Obviously your offense is a factor (I was in for fraud) and how long you were sentenced for.

All I can suggest is you get your head down and be a model prisoner. Be polite, punctual and stay away from any form of trouble or conflict.

If you have already sought legal advice, then the best advice would come from your legal representative regarding your chances. The criteria to qualify for HDC is pretty black and white. Therefore, if you do not meet the full eligibility criteria (i.e, if you were sentenced for over four years), then you are naturally going to have a fight on your hands and such results are difficult to predict.

So if maintaining innocence (I saw Drs and nurses cause injuries he was blamed for but barrister wouldn't let me give evidence) and presumed ineligible, can fulfil 2 of 3 'criteria' has a low risk score by PSR and internal probation. Good discipline record and can fulfil criteria of PSR if had been given non custodial sentence hell would freeze over before jobsworth governor woul allow assessment? I have wasted money on HDC lawyers help?

Just some advise for the few people that have made inquiries regarding the time frame of an HDC app. My partners eligible release date was 11/08/15 probation did the home visit on 20/8, didn't and the report back to the prison until 27/9. When Partner or myself called probation they would say it's just a privilege for the prisoner, we're not obliged to meet deadlines, bearing in mind HDC app is suppose to start 10 weeks before the release date. More to th point he was only given an answer last week Friday. My point is please don't hold your breath, or make arrangements relying on the prisoners release as majority of the time probation or prisons admin do not follow guidelines, they do as they please as they know they can 'gloss things' in order to reach an outcome they want, there's nothing anybody can do about it. Unless you instruct a solicitor to deal with the issues to which you have to pay your self. I was offered my dream job but due to partners HDC refusal, I've not been able to take up the position due to child care issues. Probation spoke to me as if I was the criminal, they are so rude, they get paid for what they do, it's within their work duties to deal with applications such us these but yet his probation officer would voice her self as if she's doing as a favor. It's so furinating. People may conclude I'm angered because his HDC was refused, please believe I am not, it's disgusting how the justice systems admin is so poor, and yes they have commuted the crime, they are doing their time and it's wrong for them to make personal judgments i.e, ' it's not my problem darling, he should have thought about it before he committed the offense' his probation officers words.

Is he being released on a HDC tag? If so, the Probation Service will usually conduct checks on the suitability of the accommodation and address. Their main concern is to make sure those who he will be living with are aware of the conditions and the implications of his release.

My patner got 3yr 9 month.. his laywer said his tag date is on the 1st of feb 2016.. will he be able to get the tag to an address if there has been police called to it? And will they allow him to be in the area of the crime committed? He has 2 young kids and has been given his lowcat there in august as he was a high risk prisoner. The Probation Service will usually check the accommodation to see if it is suitable before Home Detention is granted. Whether it can granted at the place where the crime was committed will be dependent upon the circumstances surrounding the crime and conditions of your tagging.

My partner is on ipp...he has is own flat and job and he was recalled because of being in the wrong place at the wrong time. He has had all charges dropped but he's awaiting his parole hearing on 5th October...will he be able to be released to my home or will he have to go into a hostel?? Offenders serving sentences of between three months and four years, (with exceptions of violent and sexual offenders), may be eligible for HDC release. Much depends upon the crime committed, as theoretically it is considered that a prisoner serving a sentence exceeding four years will be presumed unsuitable because of the risk of re-offending. Therefore it would have to be proved that your partner was at no risk of re-offending. He may just be on that cut-off point where he could be considered for HDC release. Therefore he would have to speak with his offendinding officer regarding his eligibility.

My fiancé was recently put on a tag for 4 months, we had booked our wedding before the sentence date. It was a surprise that he was given a tag on sentencing, so after we spoke to someone in probation and they weren't v helpful. So naturally we were concerned as we have 40 plus guests booked to attend our wedding and another 30 to ourreception at 7pm. We were told by the engineer fitting his tag that for pre booked weddings they would normally honour the date! So we contacted the crown court and today was told that it was rejected and that the judge thinks we booked it after the sentence date which is not the case and I can prove. It was added that it is a punishment not an inconvineance which me know but Naturally I am v upset. I am also worried as we will some how have to fit 70 ppl back In to our little house and he can't even go in the garden. We have emailed an appeal and have just asked kindly to please have until mid night! Just an extra 4 hours! that way our guest can stay at the vue rather than move to our! I have no idea what I am going to tell people and is there another way round this!

You can complain about Probation Services if you feel you/your partner has been treated unfairly. It is best to try and resolve your problem informally if you can via your probation officer, or their line manager. Hi can anyone update me on the outcome and actual length of time between hdc eligibility date and actual release date? My partners is eligible on Aug 24th but so far probation have been slow to respond, have mixed up his identity with another person in the same prison with same name, whom I made them aware of (as I know on occasion the prison mixed up our visits so I pointed out a route to take the investigation) said my partner had pending charges-which took 5days for them to apparently investigate- at which point I rang my partners solicitor to explain as both probation or prison had not thought to do this. His solicitor contacted them both within an hour and had the mix up dealt with so the process could move forward. Since then they are contradicting themselves and trying to hint that they do not approve my address for my partner to stay at. I am responsible, have a good job, have bought my home, have no children and no police record. My property is out of the area where offence took place, away from the bad crowd. Hes done numerous courses in prison, ones that address his choice in company and conflicting situations and now hes trying to put to practise they are against. All because I have been a victim of domestic violence on
One occasion and he has been a purportraiter once with one partner nothing linked to me what so ever. Would we have grounds to appeal?

I think you might be pushing it a bit here to try and get an extra weekend's break. Unless you have previously been granted permission, then you must remain at your allocated address during curfew hours. To gain permission to leave the house, the you would need to contact the customer service department of the Home Detention Curfew contractors at least 24 hours before your have to leave your residence. You will only be permitted to leave your house under circumstances in an emergency, or for the likes of a funeral, prior arranged wedding service, or a job interview.

I have recently been put on a curfew tag and in the court room i mentioned that i had a prior arrangement booked with my girlfriend of 4 years that we was going away on the weekend and that it was prebook and payed for they allowed for this date to be curfew free.

Once i got out and spoke to my girlfriend she told me that she had a suprise weekend planned for us the following week after the one they had already given me permission to have off. I am wondering how it is possible for me to get the tags curfew removed on a further date.

My girlfriend has spent alot of money and shouldnt be punished for my stupidity and i feel i have been over punished by the justice system already for a crime that did not deserve as much as i have been given.

Update on husbands HDC. His date was last Saturday, paperwork all done and been told he awaits a board slot. No idea given as to when that might be.
Is this a normal thing to happen? He's seen a couple of people get out on HDC and both where we'll over their tag date but he'd assumed it was because they hadn't started the ball rolling with outside probation.
Does a board have to take place or can they make a decision without the prisoner present? Any information appreciated, or others experiences with HDC.

@Mrs D, I contacted probation 10 weeks before tag date, now we have just passed tag date (Saturday, but wouldn't have been released till today)! Apparently our paperwork was done and had to be redone.
So my advice would be don't try and be too prepared as it doesn't seem to help.
If there's one thing I've learned, it's not to count down to tag date because it it only an eligibility date. If the paperwork/checks/board aren't done then the eligibility date just passes by!
I contacted my housing officer as we are in rented housing, to be honest it was more to explain my situation rent wise, she's asked me to call back when he's home so she can come and visit.

my husband has been d cat from start and is now in open conditions. I did the paperwork with probation officer four weeks after he went to prison ( he got 15 months so would serve 7.5 but was given a hdc date of 25/7/15)
A month ago he started asking regularly when his board would be, they told him they wouldn't look at it till two weeks before. Last week he learned that they are awaiting external risk assessments from probation! I phoned probation officer and he went over RA questions etc again and he sent them back ( again).
He's now been told paperwork is complete and he's on the list for a board- tag date is next Saturday ( I'm guessing that would mean release on Monday) but while he's been there every tag he's seen granted seems to be release 14 days after board. This is so frustrating for the family and him, is there anything I can do to help? Or anything specific he can do?
( they also did his ROTL RA a couple of weeks ago, that's not due to happen till mid August when he was hoping he'd be home anyway!)

We are going through the same process, have you spoken to your boyfriends probation officer? Outside risk assessments are done by the probation officer so he/she will need to speak to you, or the person he would be returning home to.
Once the paperwork is done he will await a board, where it is decided whether or not he can be granted release on HDC.

My boyfriend is due to start his tag date but hasn't had his meeting with the relevant people yet?My boyfriend was sent to prison for 12 months for a drunken fight he had, it is his first offence and he has a very loving family and has his own successful company but, he has done a very very stupid thing by getting aggressive and having a fight while having a day out drinking with his friends. He has had numerous jobs while being in there and has been on education courses and kept himself to himself to steer clear of anything that would keep him from returning home as quickly as possible. He has been told from the start that he will more than likely receive a tag which means he will only do a 1/4 of his sentence and I'm feeling abit apprehensive because that date is the 24th of this month. I am aware that he has to have a meeting with the OMU (I believe they're called) but, they haven't been in touch as of yet and the prison officers keep telling him "there is nothing on the system" which is a little bit frustrating because we are all waiting in limbo, I'd rather just be told yes or no at least then we know what we're dealing with. Has anybody ever been through this process before and could explain it to me? As I am completely naive to the processes that happen when someone is in prison as I've never known anybody in prison before.

@Sasskboo - If he is on licence, then on release he will have been given a a copy of the his licence condition. If he breaks those conditions by either committing another crime, or even acting in a way that his offending manager thinks he may commit another crime, then he could be recalled and taken back to prison.

My boyfriend has been let out from prison on license but between now and the start of this year he had broken several licence conditions but committed no major crime. He's now been recently arrested for assaulting a police officer but this offence wasn't committed by him in fact everything was a mis-understanding. He's now been held in custody until Monday till he's been transferred to court. Will he be going back to prison or put on tag ?

My husband had a category review in prison and he was denied it because he was told his police records showed that he had committed other offences whilst he was on bail and had breached his bail. My husband told them he had never breached his bail. Based on this information we made a complaint to the police and the police have now confirmed that they made an error inputting information onto my husbands records. This incorrect information has been on his records for over 10 years. Can you please advise what his legal rights are concerning this false information? Thanks.

@Help - The tag should be waterproof and shockproof, meaning you can wear it in the shower or bath without the tag provoking an alert to the monitoring centre. However, the Probation union, has received complaints of flaws and snags in the system. I'm afraid I can't comment on what might happen, you could perhaps ask your probation officer to have the tag replaced.

Hi. I've been on tag for 8 weeks now and have a few days left. Since installing the tag it has gone off every time I have a bath and randomly in the night while I'm in bed. They have said this is a mark against me even tho I've never left the house. I've asked them to come and check the box but they refused to saying it's not faulty. The tag never had to be moved as it never went to my girlfriends.i now want to change my address to my girlfriends, I know I have to ask the prison but want to know if this is something that can be done and how often it does happen when people ask for there address to be changed

The probation officer was really helpful he came and done the home check. And now its taking forever and ever! My sons hdc eligibility date is long gone. It's really frustrating especially for my son! Everyday we are waiting for news, I call up the prison Omu every other day but they are no help! first time in this position too, hope it's the last! @Wilks. I am in the same position ..my son has been told his eligible release date is 1st June & the probation off have still not received the HDC form from the prison! They've confirmed he has been granted it so I asked if the home visit can be done whilst they are waiting so they are coming on Tuesday. So yes the probation officer will do the checks. I've done all the chasing (along with my son) I'll be amazed if he's home the following Monday. Good luck .. Our families first experience too & hopefully our last luckily only been 8 weeks but no support via post or phone calls so I would've been lost without the internet!

I have rang the probation service 4 times to ask about the progression of my son's hdc. The first three times they were very pleasant and helpful. The last time the woman I spoke to was really horrible and told me to stop ringing them it was nothing to do with them and she raised her voice and was ridiculing some of my previous questions. My famiky has never been in this position before so we don't know how it all works but from what I've been told it will be them that will be doing any checks on our home. Is that right?

My hubby got sentenced to 2 yrs n was due hdc on 30jun.now he has been advised he won't be considered as he had in 2005 breached his licence went back to jail but been out since Nov 2010 until Nov 2014. In his reviews n video links hus probation dud not mention he won't even be considered and was under the impression he will be reviewed.it was only bought up when I spoke with my husband as the prison advised him they were waiting on his probation.after chasing his probation they said they waiting on prison . prison then told him they not gonna recommend due to breach.thus is unfair.he worked on a committed plan to become drug free which he done them once he done that was told no recommendation. The issue now is that I gave been diagnosed with lupus sle and been in hospital since last week.we have 3 children and having him home on tag would help him kids and me.is there anyway recommendations can be made as I believe it's down to the governor by reading on the Internet.

Hi my partner was sentenced to two and a half years for conspiracy to defraud he will serve 15 months but he's solicitor has said he will get tag. Can he go to dcat and still get he's tag. We are awaiting a retrial also as the barristers requested an appeal for unfair trial when summoning up the cat he put him under an a instead of b the sentencing should have been 18 month not two and a half apparently how likely is it the appeal can be over turned?

I'm hoping you can provide me with some advice.

My partner is currently serving a 15 month prison sentence. The sentence was for Conspiracy To Defraud - 2012, Breach Of Community Order & Breah Of Suspended Sentence - 2014, he also has two more breaches of community orders in 2011 & 2014.

He has been given his eligibility date for July this year where he may be released on HDC. I have spoken to the deputy governor of the prison he is at & he stated its unlikely he will get his HDC because he has a breach of trust on more than one occasions in the last five years.

I have since read on the internet that a risk assessment will be done. He has a stable family home to return to, a young child and a supportive family, as well as his own business and the opportunity to return to higher education.

Hi, my partner was sentenced for 9months, he is eligible for HDC. He filled out all necessary documents for the HDC request, I was advised by the prison that the paper work has been sent to the probation service an i would need to call themself or await a phone call. Upon calling probation they have informed me that they do not have any information on my partner. I'm going round in circles. How long does it take for the probation service to call me back?? What could I do so that I can assist as my partners HDC date is coming close yet I have not recieved a phone call nor letter to my home address to say they will be visiting to do all necessary checks!!

I've been tagged,I smoke in garden as property is private rented and non smoking. My partner is pregnant. My tag restricts me to my home I can't go in the garden,is there any way this can be lifted ?

I've been given 18 month on the 11th may but I've been on tag for three month and never broke it so will I get time of for that and will I get it again on early release basically I'm trying to find out how long I will actually do in prison please can anyone shed some light on this matter

@JoB - it really depends on what the board decides, so I can't really advise. However, he will be asked to permanently to reside at an address approved by his supervising officer and if you would prefer that address to be yours, then you should put yourself forward.

My son n law got sentence July 2014 for 5 years his due out in Oct 16 serving half but got to be good until 2019, he's been moved from one prison to another and on his paperwork it said medium for Hostel. We have said he can come live with us. Can this be done or has he got to go into a hostel miles away thank you x

My brother was sentenced on the 4th of November for 26mth and has been given a tag date for the 23rd of July , it was joint enterprise and punching someone, his first baby Is due the same as his tag date this is his first offence what's the chance of coming out on that date on tag , I'm worried it could get refused

@slim - if he has been recalled, his licence may be revoked and the length depends on whether he gets a fixed term recall (a fixed period of 28 days). If he is not eligible for a fixed term recall because he has been serving a sentence for a violent or a sexual offence, or he is serving an extended sentence it may mean he will remain in prison until the end of his sentence or until the parole board decides he can be released.
There is also an emergency recall, when it is seen that their risk of harm or risk of reoffending is deemed too serious to warrant release. You will really need to speak to his solicitor to find out what is going on and when he will be released.

My partner got recalled back to prison on the 27th February 2015 because he smashed my kitchen window. I told the police officer that i don't want to press charges against him and i have written a statement also. The police called back and said they have drop the charges against him. He is still in prison for over a month now. When will he get released? As i have not press charges against him and my case is now closed.

@Emmabo - if he is eligible and he is serving a sentence of eight months but less than four years his time served before HDC would be half the sentence minus 60 days. A risk assessment by the Probation Service will be undertaken. He wont be eligible if he considered a risk to victims and the public, is likely to re-offend whilst on HDC, is likely to fail to abide by HDC conditions or has a lack of suitable accommodation. are serving an extended sentence, are serving a sentence for absconding/failing to return, have previously breached a curfew order or were recalled for breaching the HDC scheme, have been detained under mental health provisions, are subject to notification requirements under the Sexual Offences Act 2003, are liable for deportation from the UK, or their early release date for for HDC is less than 14 days from the halfway point of their sentence.

@Ilona - There are certain types of offences which mean that a prisoner is presumed to be unsuitable for HDC and those offences include; murder, attempted murder, threats to kill, conspiring, aiding or abetting, or death by dangerous driving. If he is eligible for a tag (his offending officer should inform you) then he should be eligible after two months.

Hi, my partner has been sentenced to 9 months so will be out in 4.5 months. He's been told he's eligible for tagging on the 28th may. He was told he has to have an address by the beginning of May otherwise he won't come out before his 4.5 months. I'm currently looking for somewhere for us to live but obviously only have 3 weeks in which to find somewhere if what he's been told is true. Is what he's been told true? If I'm renting somewhere do I have to inform the landlord that my partner will be on tag living at the address.

Hi, My husband has been wrongly convicted to 11 years. His appeals have been refused. So far all together he has served 9 months - 2 months on tag whilst on bail awaiting trial. He will be having a Sentence review next week on 7th April. Does he have any chances of being considered for HDC as he has never breached, nor any convictions & I'm also a civil servant. Please advise as I'm also writing up supporting letter for this meeting.

Depends also what kind of offence he's in for, the governor will take that into account, if it's a non violent crime he should get hdc. He should be out about about 3 1/2 months into he's sentence.

My brother has just been convicted of GBH section20 he was given 8month sentence and will serve 4 I understand he will be eligible for HDC release after 2months is this correct? It was his first offence and completely out of character. He also has a job to come out to. Are people normally given HDC release with this type of conviction? would they take into account his references and the fact it was single blow?

My partner was released on HDC last Wednesday, 18th March. On Sunday the tag fell apart whilst on his ankle. He had caught it while at work the day before, possibly loosening it? He contacted the company to inform them of what he had done and asked them to come out and check it. They refused to do this. At 4.20 this morning they breached him and recalled him back to prison insisting he has tampered with the tag/snapped it off, even though he sat and waited for them to call out and fit a new one and stuck to his 7-7 curfew. He has approx 4 and half months left on his sentence. Will he have to finish the four and half months or be recalled for 28days? His probation officer doesn't seem to have a clue as she told me he will do the 28days but then changed her mind when I pointed out its a prison HDC. She also told me it will be pointless appealing against their decision as he will deffinatley be refused. Any advice?

@Sosna - The only times someone may be permitted out during their curfew hours are for awedding or funeral (service only) of a close relative, a job interview, acting as a witness in court, or for emergencies. They may allow your partner to attend the birth of your child, but he will need to contact the customer service department of the Home Detention Curfew contractors in order to gain permission. He could also have a word with his probation officer to see if he may be able to gain permission that way. You may need a letter from your GP to authenticate this.

Hi, I need to attend a wedding. I'm on TAG and my curfew is 11pm. I live in London and wedding is in Newcastle. So will be back the following day at midnight. Hi @lou74 as I believe people on sex offenders register are eligible for tag as long as they are not serving a prison sentence for that offence! They are eligible but will have to have an enhanced assessment done and be a low risk towards public! I hope that helps?

his tagged address was contacted on the 9th and we didn't hear anything from his probation other than released on tag would be for the 28th if that makes sense?
he got rejected but we are unaware of the reason why this has happend

@anna - Your partner will be told the reasons why his HDC has been refused. He can appeal against this decision and his solicitor should advise him if he has a chance or not. Appeals can be done through his solicitor. I hope this helps.

@anne - If he qualifies for a Home Detention Curfew then his risk assessments will normally begin around 10 weeks before the start of his curfew date and he should be informed of this. He will be given the forms to complete regarding his curfew address etc. I hope this helps.

My partner was sentenced to 3 years and has been serving his sentence since the 3rd February 2014. He was given an eligibility date of 3rd February 2015. Probation have done their bit and telephoned to carry out the necessary checks on the address but we still have heard nothing from the prison. He did have a tag board back in January but he was told he would have to have another after probation had done their bit. I am very worried about him as I know he is really struggling and is very down and depressed at the moment. Is there anything else I can do? And how long would you usually expect it to take now from this point? Thank you.

I have was sent a warning letter from the tag company for failing to answer calls while I was asleep. The reason they called was because they thought I was absent when in fact the machine failed to pick up the signal. I was then sent a final warning letter because I moved the machine closer to the shower so it could pick me up. They said I was tampering with the equipment. How do I prove I was actually in the house during the first incident and if recalled, will I be in custody till my automatic release date or till my licence expires?

@Stressed&Depressed - it's hard to say as the prison service seems to be a law unto themselves and aren't aware of time. The thing he has to make sure of is that the board has all the right papers and documentation, as it is not having the right paperwork that can add to further delays.

My boyfriend was sentenced in August 2014 to 24 months. He's due to serve 11. He was granted eligibility date of 9.1.15 and is still in there over a month later. Probation services came to visit last Tuesday and have said they are are happy and now have to wait for prisons approval etc. How much longer do we have to wait? Each day that goes by it gets harder and harder and I feel like I'm going to lose my mind. Please offer some advice :(?

Hi, my partner filled out the appropriate HDC form and I have had a home assessment done by the outside probation service. They have recommended the tagging. His HDC eligibility date is tomorrow 10/02/2015. He has had no decision back yet but told me today that the Governer has said to him that he has asked the HDC people to come and see him in prison. Please could you give me any guidance on what this would be about.

@Claire - The Probation Service usually checks the suitability of the accommodation before a HDC app is approved by either visiting the home or make a telephone call. When it goes to the board, it is carried out in an ordered basis. He just has to make sure that the board has all the correct documentation required, as it is lack of the correct of information or forms that have not been filled out properly that is the most common cause of delaying the process.

@Justinex - I'm afraid there is no way we would be able to assess whether he would be eligible for HDC on appeal. When a Home Detention Curfew application is refused the prisoner will be informed and told the reasons why. The only recourse he has is to appeal against this decision through the prison complaints procedure or through his solicitor. I hope this helps.

My husband is serving 18 months for conspiracy to commit commercial burglary, he has a long criminal record but offending has significantly reduced in last 5 years. He was in another prison and they refused to even let him apply for hdc saying that breaches of bail make him unsuitable. From what I can gather he should of still been allowed to apply as he doesn't meet any conditions that make in ineligible or presumed unsuitable. He has just moved to a local prison, what are the chances that he will be allowed to apply if the previous prison has made an incorrect decision? His tag date was last Monday and his co defendant has same criminal history but got d cat and subsequently released on Monday. I'm desperate to have him home I'm a full time student and we have a disabled child, he also has employment being kept open for him when he is released, any advice would be great.

Thanks. If my partner has been assessed as medium risk, what does this mean? Would this affect the HDC decision made? This was due to the fact the internal probation did not have all the case details so assumed he had no remorse. Also he was recently moved to a different prison. He did fill HDC form in the last prison, however they have asked him to fill this in again in the new place. Does this mean the assessment will start all over again and this would delay the HDC?

@clairy x - Any drugs offence (previous convictions for drug possession do not exclude prisoners from presumptive HDC). The presumption of unsuitability will only be displaced in very limited circumstances, and
will be determined on a case-by-case basis. Prisoners serving sentences of 12 weeks or over but less than four years’ imprisonment are
eligible to be considered for HDC once they have served half their custodial sentence. I hope this helps.

Hello my husband,just got sentenced to 44months in prison for intent to supply, so will surve 22months.. Our son is due next month,so i am in pieces! My question is when can he apply for tag. Open prison ect! This offence happened over a year ago. He completely turned his life around got a full time job ect,this is the first time he has been to prison my question is if he gotta do 22 months when can he apply for tag..or open prison?? Anything i need him home for our son :'( someone plz help

@sam - if your address has been given to the parole officer then it is worth you contatcting them to try and secure an appointment for a visit, so they can check its suitability and interview those living there. This time can be a little frustrating, so it is wise that he has his paperwork complete as any slight hitch might cause a delay. I hope this helps.

my partner was refused HDC at his own address and has had the chance to give an alternative address, which has been approved by outside probation, he hasn't heard nothing from the prison yet, when he asks they get very annoyed, just wanted to know how long can it take, his provisional HDC release date was december. And is there anything i can do to find out?

Hi my boyfriend has not been found a hostel.the Hdc thing runs out on the 28 th I have rand the Hdc people they are saying he will be released then as that's wen his tag exception runs out,his actual release date is jan 12 th does any one know if this is right,or could it be because they couldn't find him accommodation

@Mani - it would be something you would have to speak to his solicitor about, depending upon the circumstances. But as a rule the dates are generated automatically. A release tag is available to prisoners with sentences between three months and four years. The eligible date is the later of 25% of the way through his sentence (equivalent to 50% of the way through his expected time in prison) and four months before 50% of his sentence. For example an eight month sentence = four months in prison = tag date after two months in prison. Having the paperwork ready is key and will ensure there are no delays. Each case is usually dealt with chronologically and in order of eligibility date. However, there is quite often a backlog when the prison is behind in admin, and this can often cause a bit of frustration. In the meantime, I would ensure you speak with his solicitor and make sure you have everything ready to go and additional documentation that can help back-up his case for release.

I would like to know whether prisoner can be released early on HDC before the eligibilty date of HDC. My son is in open prison. He was sentenced for 3 years for false representation in March 2014. Even Judge agreed that my son was not main culprit but he was taking a can of sentence as his so called friend cheated him and remained absconding. This happened during University time when his senior friend trapped him by offering a part time job then started to open business accounts in his name. He had seizure recently and that happened first time in his life in open prison. He co-perated police and remain faithfull to laws during bail.

My boyfriend was told 3 weeks ago he could have tag but to a bail hostel his solicitor has wrote to the govenor and said he should be tagged to home,the prison have now made him go today and give an address when he has done all this. Does any one no wats going on

@Di64 - It usually goes like this, a HDC suitability assessment will take place before his eligibility date. Probation, will usually carry out a suitability test prior to the assessment and on the back of information gathered by his solicitor and prison staff, the board will then consider whether he is eligible.

Can he be moved closer to home so I can visit him more as I don't drive . And all so how soon can he get out .first time in trouble . I can't even think strat am devastated .

What's the longest someone can be kept on tag while on bail ? As it's been over 5 mouths so far and still don't have a court date ? Did have a court date but the case was so weak that the police stopped it from going ahead put me on bail for something else which again I never did I beleave all because I made a completed against a d.c.i for swearing at me on CCTV in the police station he was deal with in house and is still in charge of the case ? Sorry i know this don't help anyone here but was the only page I could find on HDC .

hi im currently awaiting sentence for an offensive weapon ,in the plae of mitigation to the court I accepted being in possession of it although I had taken it off my neighbour in his house when an argument started with him and his brother,i was released on bail after a 7 day remand under a curfew from 6am-8pm that's a year ive stuck to the curfew ive been told by some people to expect 2 years because I have previos convictions from 1992-2000, I was 16 or 17 in 1992 and was 24 when I last received a prison sentence in 2000 ,I was wondering if im eligible for HDC and if I do receive 2 years when will I be eligible to be released ,I mean how many months will I have to do in prison ive again been told half of 2 is 12 months then 25% of that is 3months so is it 3 months I serve in prison or 9 months as that would be about 3 quarters of the 12 months release date any help is appreciated thanks

Follow up to my original enquiry at the start of this forum. My son was not eligible for HDC (even though he was given an HDC form by the prison at the start of his sentence). I spoke to the Ministry of Justice and was told that Death by Careless Driving fitted into the same category as Death by Dangerous Driving (even if no alcohol or drugs were involved), therefore there was NO HDC allowed and he had to serve the full 7 months at Glen Parva. We did try to appeal the sentence legally, but to no avail. We also tried to appeal directly to the Governor of the prison on mitigating circumstances like the massive head injuries that my son sustained in the accident etc . . . unfortunately it was rejected.
It seems that the law and sentencing is far harsher than before when cases of Death by Careless Driving come up and is incredibly hard to get information on, so I would suggest that you speak directly to the Ministry of Justice to get the facts and then appeal to the prison governor through a law company with a mitigating case. Hope this helps . . .

Hi please can someone help me partner was jailed on the 24th march for 5 month for death by careless driving just really bad accident he was due to be released on tag for the 9th of June but it has been rejected by the governor he is going to appeal this will it make a difference ??? Just want him home it's been really hard on me & the children .

Hi my son was due his tag on the 8th of April he was refused but he apealed and the governor allowed him his tag it is now the 23rd April and he still is not released . Why is it taking so long as his probation officer has been to my home and done her checks which she was more than happy with .

Hi my son has been given a 6 month sentence which was unexpected firstly he is under a previous name which is now not his legal name and hasn't been for some time , he has been told he may be released on hdc is there any way to get this process done quicker as my children are suffering without there brother being part of there family life , please help as this is a first time experience with little help available

hi my boyfriend was released on licence after getting a year sentence suspended for two years for burglary..however he ended up breaching his licence but did not get arrested until a year later and then was sentenced to six months in custody and then another six months licence .he hadn't re offended at all before he was re arrested but they said it was absconding and breach .So is he now still eligible for h.d.c and how and when would he find out about this? any help would be grateful thankyou

Hi my son also was jailed jan 24th 2013 for death by careless driving and has a 4 year sentence for 2 deaths he also wasent drunk or under the influnce of drugs and it was a terrible accident and we been told he cant get HDC AS WELL AT GLEN PARVA so what I need to no is is that only at glen parva as his probation have said he can get it can any one help me and his dad on this as we dont no what to do

Hi my partner is due to be tagged from his mums address in one month and told me probation advised him not to put my address down when applying for tag as I've only lived here for fours months (even thou its a secure council tenancy) and she also told him as he is a only child and never lived with children that wouldn't get accepted however the child at my property is his son he would be living with me an OUR son so am very confused why his probation officer would advise him to not put my address down we're I and our son reside??! And for him to go to his mums knowing tag can be 7-7?? Please tell me if this is true or somebody is not being honest here aha thanks appreciate it

My hubby served 6 month on HDC before being convicted in August. I know the time he spent on HDC will come of his sentence "as time spent" however his HDC release date was 25/11/2013, he only found out yesterday that he is not eligible. He put an appeal in right away, bare in mind he didn't not once breach his curfew before he got convicted he was quickly an enhances prisoner he followed all the correct guide lines he completed all the correct courses etc... Can any body give me some advice on what is the best next thing to do? How long does this appeal take? His release date is 7/4/2014 and he is over his half way point now. Any advice I would totally appreciate, Please. We have a disabled son at home, all we want is daddy home for Christmas. They can have him back after lol I'm kidding. We are so desperate to get him home i don't know how I'm going to explain daddy not being there Xmas day to our disabled ray of sunshine.

My son has been turned down for an early release on tag because we were the the victims of an arson attack by someone my younger son knew from the age of 10. He arsonist was jailed for this as we were asleep when he started the fire and we lost 2 dogs and a cat in the fire. This has nothing to do with my son that is in prison. Is this a reasonable case for turning us down as we have been the victims here through no fault of our own?

hi, my partner was jailed on 11th feb 2013 for assault on me and my daughter,he was given 15 months so should be out in 7 and a half. he was given an hdc date of 5th june2013, he has now been told that hes NOT ELIGIBLE because of a previous crime 20 years ago.if laws are changing all the time how can something so long ago stop the hdc. we have been in contact by phone letter an visits and plan to marry on his release, me and my children want my partner back with us an to carry on with family life. this is so upsetting for me an my family, my partners mum and very poorly father, this must be even more upsetting an sole destroying for my partner, is there anything i can do to help, anyone i can write to ect. i would be greatfull for a quick reply by email thank you .
