How Immigration Hearings Work in the UK
If your immigration application has been refused, you may have the right to appeal the decision. This appeal is heard at an immigration tribunal, not a criminal court. The process differs from what you might expect if your only experience of courts comes from television dramas.
Immigration hearings take place at tribunal centres across the UK. Since the pandemic, many hearings now take place by video link, so you should check your hearing notice to confirm whether you need to attend in person or join remotely. A legally qualified judge will hear your case. In some situations, the judge sits with one or more non-legal members who bring other expertise to the panel. There is no jury involved in immigration appeals.
The atmosphere is formal but generally less intimidating than a Crown Court. You will usually sit at a table facing the judge, with your representative beside you if you have one. A Home Office presenting officer will attend to put forward the government's position on your case.

An appeal can follow several types of refusal. Common situations include:
- A refusal to allow entry to the UK
- A refusal to grant leave to remain
- A refusal of an asylum claim
- A decision to deport someone already living in the UK
- A refusal to issue a family visa or spouse visa
Appeal rights have been significantly curtailed in recent years. Decisions on human rights and protection claims often carry appeal rights, while refusals under the points based system generally do not. Some decisions can only be challenged through administrative review or judicial review. The refusal letter you received will explain whether you can appeal and the deadline for doing so. These deadlines are strict, so check them carefully.
If you are in the UK, you will usually have 14 calendar days to lodge an appeal. If you are outside the UK, the deadline is typically 28 calendar days. Bank holidays count towards these deadlines, so factor them in when calculating your timeframe. The appeal is submitted to the First tier Tribunal (Immigration and Asylum Chamber).

Types of Hearing
Most appeals proceed directly to a full substantive hearing, though in some cases there may be a preliminary case management review hearing first. If a case management review is scheduled, its purpose is to identify the issues in dispute, check that evidence has been exchanged, and set directions for the full hearing.
If you do not have legal representation and a case management review has been scheduled, attending is important. If nobody appears on your behalf, the judge may decide to determine your appeal on the papers alone. This means the judge will read the written evidence and make a decision without hearing from you in person, which limits your opportunity to explain your circumstances directly.
Adjournments of hearings can be granted, but tribunals require strong justification and do not grant them routinely. If you need to request an adjournment, do so as early as possible with clear reasons.
The full hearing is where the judge considers all the evidence and makes a decision. You will usually be asked to give evidence and may be questioned by the Home Office presenting officer. Any witnesses you have asked to attend can also give evidence. Your representative, if you have one, will make legal submissions on your behalf.
Hearings can last anywhere from a couple of hours to a full day, depending on the complexity of the case. Asylum appeals and human rights appeals often take longer because they involve detailed evidence about personal circumstances or conditions in other countries.
Preparing for Your Hearing
Thorough preparation can positively influence the outcome of your hearing. Gather all the documents that support your case and make sure they have been submitted to the tribunal and the Home Office in advance. The tribunal will usually set a deadline for evidence, and late documents may not be accepted without good reason.
Bring copies of everything with you on the day. This includes your appeal bundle, witness statements, and any identity documents. Arrive early to allow time for security checks and to find the right room. If your hearing is by video, test your connection and equipment beforehand and find a quiet space where you can speak freely.
If you need an interpreter, inform the tribunal as soon as possible. They can arrange one at no cost, but only if you request this in advance. Using a professional interpreter ensures accuracy and avoids misunderstandings during questioning.
Think about what questions you may be asked. The judge and presenting officer will want to understand your circumstances, your reasons for wanting to stay in the UK, and any risks you may face if removed. Answer honestly and as clearly as you can.
Legal representation is not compulsory, but it can help considerably. Legal aid is available for certain types of case, particularly asylum and some human rights appeals, though eligibility criteria are strict and availability is limited. You can search for a legal aid provider on the GOV.UK website or contact organisations such as the Immigration Law Practitioners' Association for help finding advice.
After the hearing, the judge may give a decision on the day or reserve it for later. A written decision will be sent to you, usually within a few weeks. If your appeal is refused, you may have further options depending on the grounds, including asking for permission to appeal to the Upper Tribunal, which reviews decisions of the First tier Tribunal for legal errors.

My solicitor told me they don’t appeal against cases like mine- entry clearance case. But then I was the unlucky one they did appeal against the judges decision. I really hope they don’t for you. It’s not fair to go through the whole process again. Keep praying.

Further, I received a reply to my email on the next day saying “the request for the change of name has been forwarded to a senior colleague for review as soon as possible. Until this takes place, we will halt production of any BRP card.

The upper tribunal court date came the next day after the home office appeal was accepted.
So I don’t think anyone knows when the hearing date can come...

At the end of hearing the Judge said he will give the decision in writing in couple of weeks but I haven't heard anything till date. I called up FTT and they said the decision is still with the Judge.
Any idea what could be the reason for the delay? (It's the 7th week and if excluded the 2 weeks of Christmas holidays then 5th week.)

I think it’s difficult to say ...
my case was allowed under human rights so when HO asked for permission to appeal it was refused. There wasn’t a error of law that the HO found. They still have one more chance to ask for permission to appeal at the upper tribunal ... still waiting

I had my hearing in 21 August 2019. That day the person who presented Home Office and Judge agree that my case was clear and thay hadn't to much to talking about. After the hearing the Judge said that the decision will be made after 3 weeks. I was waiting more than one month and no letter came to my house.
At 5 October 2019 my solicitor contacted the Tribunal and thay said that the decision was made at 10th of September and was positive and was send by e-mail . Home Office haven't appeal. We applied for a copy of the decision by writing. 15 November 2019 the Tribunal send one copy of the decision in my house. On 27 November 2019 Home Office appeal my case. Now I have to go in Hearing again and I am worried about that.
How much possibility have that the decision to be positive again?

my advice to all is please take your time in choosing the correct solicitor, advocate for your case. Go with your gut instinct... please try to be patient ... I understand it’s hard I’ve been through the waiting game ... now I’m just waiting for the home office email ...

Appeal was dismissed judge stated I can go and live in India. I’m a teacher have a career that I love, family and all are friends. Bottom line is I don’t like India, sorry if I’ve offended anyone here.
I can only go and see my husband for less than 2weeks due to personal circumstances, I fell pregnant at the beginning of September, found out it’s a ecoptic pregnancy. I had to have surgery... distressing experience without my husband... it’s going to be three years next month when we both decided he should go back and we will do everything the proper way get his entry clearance ... we have submitted a new application still waiting for a decision that can take up to 6 months or more if we are still unlucky ... I don’t even feel like telling the home office as I feel so shut down ... what are the chances of them understanding ... God knows ...

I received a letter from UKVI saying that leave to remain as spouse has been granted and I should receive my Biometric card in 10 days. When I check application status online today it still says awaiting for the decision. I recived the letter dated 21/10/17 on 2nd of November 2017. My appeal was allowed on 6th of August 2017.
Do not trust the online as it’s not 100%.
Thank god the things end positively and me and my wife can live a normal life. I cannot imagine that we had to go through this all. Feels good to feel normal again. I pray for all of you to have the positive outcome too. I know it’s very very stressful but for now keep yourself very busy learn as many things as you can because stress does not help. Keeping busy helps you a lot and makes you feel normal. It’s a top tip(ignore if it doesn't apply or you don’t agree).

My appeal was allowed last year but home office made an appeal against that decision but turned down by FTT in may 2017 stating that there was no error.
I have not received any update as yet. Not a single piece of paper by home office. Bit confused what to do next as they have crossed all of their lines to put this up in upper tribunal or go for judicial review.

If they grant permission there usually is a oral hearing at the upper tribunal
If they refuse permission to appeal then you have to apply to the upper tribunal for permission

Here is my timeline, if this may help you guys. I applied FLR (M) back in November 2014, got refusal based in November 2015 and there two allegations were raised by SSHD i) suitability and ii) relationship is not genuine. Appealed to FTT in November 2015, got first hearing listed for January 2017 which was adjourned as respondent presented some documents on the hear day and Judge did adjourn the hearing. I got my case relist notification back in April for the August 14, 2017.
Me and my partner went there they did interview us separately almost all the information matched with each of us but few bits were mismatch but overall was good.
It was 2 hours long hearing, we been asked a lot of question about our families and in case if I sent back to my country how that will affect the life of my partner. In the end, Judge said he will write the determination latter in a foreseeable time frame as its all depend on work load. No such deadline was given to us. So good luck to all those are waiting. Wait isn’t over yet for me at least ?
When did you tell your parents? When did he propose ? then my father was asked questions about his character. the judge will give you time to say what you want at the end, so speak your heart out. hope it all goes well for you.

Has anyone been in the situation that evidence sent has been completely neglected ? I sent approx 16 pieces of evidence and on the refusal the ECO stated he received 1. This is the second time evidence has been neglected in my case and wonder if it's some sort of victimization towards myself or evidence tampering.

I had the history of overstaying but I did not leave the country as my wife was pregnant.
I did not even think about my expired visa because what really was important for me was not to be away from my pregnant wife and being first time father got me extremely occupied.

The reason for refusal was 320 my husband came to the uk illegally. He wasn't deported back... he left in Dec 2015 we got married in India and I came back home...
there are many cases of illegal immigrants who come back if they are not deported ...

I am hoping someone can help me understand how long I might have to wait for a tribunal hearing. My husbands visa was rejected on the basis that they did not believe this is a genuine relationship. This was in February and we began the appeal process in March. We were told the docs have been forwarded to home office to overturn their decision for which they have 15 weeks. The 15 weeks are up on 24th July so I decided to ring tribunal today for an update and was informed that on Monday I will be given a hearing date but it is likely to be in Autumn. I've been dealing with some health conditions recently, which has made it harder without my husband here. I've been abroad to visit my husband 3 times in the last year so we can at least be together where possible but this is becoming very costly now. Please please please can someone give me a realistic idea of how long I might be waiting for a court hearing as I expect on Monday I will only get a notice of appeal sent to me and not a date or anything more tangible. Any advice I can get at this stage will be much appreciated. And I pray that all of your burdens are lightened soon because I can't imagine how it could feel to be waiting for so long x

For my bundle I included payslips, bank statements, evidence communication and accomdation letter (extra things), statements from me and my husband dated and signed - the judge told me he doesn't need to look at the documents provided as he is only going to focus on the reason of refusal...
I didnt need to refer to my bundle but make sure you have a copy for yourself. You need to send one to presenting officer! And one for the court. The home officer didn't even turn up for my case...

Apologise on your husband's behalf for coming into the country illegally that will get noted... there are reasons why people come here illegally so just tell the judge the truth... fingers crossed for you!

@Alb the spouse visa was refused for my husband who's in India, Punjab because he was illegal here and worked while he was here the eco refused the visa and accused him of travelling on a fake passport.
The judge only focused on this and asked questions like why did he come here? What was he doing here? Why did he not report to the home office(signing) ? have you thought about moving there? What would happen if he didn't get his entry clearance ? when did you meet? My father was with me and was asked to leave the room and when he came back in he was asked about my husband's character and about his family ...my dad was the only one who attended my wedding from the uk because it was planned last minute, I told the judge if my husband wasn't a honest loving man there's no way I would have gone to India without my mum and got married ...hardest thing to do ...he looked at me and said I got your point...the judge asked the similar questions to me and my father - how many brothers does he have? Does he work there ?

It was only 30-40 mins of hearing. The judge said , i will receive the decision within two weeks. So what do you think is happening now?

Just remember that when you deal with the court, for whatever reason, knowledge is power. Use Google to do some research. You will learn a lot!!!
We had removed our legal representative off the case (contacted the tribunal) there is no way that they will give him any information about our case if he is off right ? I'm so worried he will try to jeopardise our case, he turned out to be a total con artist he uses the title judge...Singh and asked for a ridiculous amount of money to go to the hearing 5000 pounds we removed him. I called the tribunal explaining this and the lady said they can remove him which was done. But i just have this fear he will contact the tribunal... my husband and i have told the tribunal not to give him any information about us. Can't believe what mess we are in but definitely learnt lots of lessons along the line. The tribunal won't give him any information right ?! feel like we have lost trust .... it's like a game and we still heading to win.., all the best Don!
Yes it is a disgrace that we have to live this nightmare, but some good will come up out of it!

Stoke on Trent 10am. We got there at 9am just to be safe and our hearing was the last one and started at 12pm.
My representative was my older brother, but was told from the clerk in the morning that he can not be the rep as he has no legal stats, only a barrister or solicitor can talk on my behalf. Also, the Entry Clearance Officer did not turn up for the hearing, the clerk said this can be a good sign!
When we got into the room, the clerk said that my brother may be able to representative me and then the Judge said to my brother, sit in the Rep chair and if I have any questions to ask you I will, but for the time being I will answer all the Judges Questions.
The judge said I can see your relationship is genuine and the ECM refusal was because of not providing land deeds and proof of paying tax on rental income. The judge asked me questions outside of the refusal comments, i.e where is your national insurance contributions on the rental income, something we did not have because we were not asked for this and we were unawares from the ECO & ECM. I did state to the Judge, everything the ECM refusal comments we included in the bundle which he did check. Also on the employment letter the Jugde said your Manager has not put the gross income I receive on there, we had A P60 and Payslips to prove my gross income. Again, something the ECO and ECM did not pick up on at the time
The Judge said from the start of the hearing that I will not make a decision today and I would have to wait up to 4 weeks for a decision to be posted to me. Fingers Crossed! this has been emotionally stressful and my wife can not take it anymore.

If you don't mind me saying, don't hope too much for it to be withdrawn you have waited more than a year...only a couple of weeks to go and if it goes to the tribunal it's good so the judge can see another case (waste of time and waste of money ) it looks bad on the home office! They should have trained eco and ecm ... the bottom line is you will win! HOPO won't know what to say... either way you will be fine! so don't hope anymore it's going to come to an end .... I nearly drove myself crazy hoping ...all this overturning business is all bull ...if it goes to the tribunal stand up tall! :)
The ECM signed the documents in May 2016 and we got them in 1st March 2017. Hope that makes sense?
When did you receive the ECM refusal was it after the notice of appeal (when you hope for it to be overturned) ?
My court date is on the 8th June, I've sent of the bundle evidence that the ECO refused on. I don't have any document of the ECM ...

If you believe you have a strong case, show them by not being afraid! Be confident and keep eye contact with both! Smile, that's the killer! Home Office hates when the defendant is calm and in control. They can't react at it!
When I had my hearing, I was smiling and kept calm. The HO got confused and uncomfortable and the judge noticed it, that's why the judge ruled in my favour.
Remember just stay calm, take a deep breath and be confident in what you say!

Visa refused because HO thinks relationship is not genuine. It is not genuine because the address you provide that your spouse lives with you could not be verified by credit rating agency Equifax that you spouse is living there? And you have submitted all the proof of address you could.
Just report you address being used by some one illegally in the UK, just give some random name,nationality,DOB and mention this guy entered illegally and let them come and see for themselves that if you are living as a couple or not.
Who else can be better witness?
After that they might overturn the decision because it will be unwise to go to court and upheld the original decision or try to bite own ass!!!!
Best thing to do is contact the tribunal and find out if your case has been listed, it takes 48 weeks from then.
If it's a spouse visa appeal they usually are seen up to 15-18months.
If they do it will go to upper tribunal..

The judge will look at the points of the refusal and will need evidence for that...I doubt it the judge will question your relationship. But then again you never know ...keep communication evidence for the hearing as back up there's no harm just time consuming :)
In the appeal hearing. Will the jugde ask me for photos/skype etc since the appeal rejection and hearing date.
Altough in the paperwork the case owner says they are satisfied with the marriage, whats to say that jugde can ask for more photos chat history since Feb 2016 and May 2017 because my application was rejected in Jan 2016 and we appealed in Feb 2016.
Home Office is unwilling to accept defeat and prefer to appeal any case to discourage us and give up..... good luck everyone.

My spouse visa they say marriage is geniune which i am relieved about, I have to submit land registry papers of a property I own and I need to submit self assessment form on the tax I gave to HMRC so the Home office can see I pay tax on the property I rent.
If we think about it the whole process still takes up to 18 months, it can happen before that but that is the time... for example PK appealed in February 2016 and has a date for June 2017 so really it's taken 16 months and then may take another 2 weeks or more to receive the visa ...

I have an appeal at ftt over eea efm refusal of rc.
Last week my solicitor told me tribunal had adjourned the case and not told when the next hearing would be. This is 2weeks before the hearing.
I don't know what to do a's I'm not doing anything to support my family i.e my unmarried partner, besides looking after our daughter and chores at home.
I'm so tired and I wonder if anyone has been in my shoes to enlighten me on what this really mean

I called the tribunal this morning to find out if the hearing date is set. The adviser told me it's takes average 48 weeks once sent to hearing listing team. Also the adviser confirmed that my appeal haven't been sent to hearing listing team yet.
I wonder how long the whole process will take.

MP can't help in immigration matters anymore ...
Spoke to my MP in Sep 2016 to ask immigration how long it would take and they responded back saying on average within 12 months and in some cases longer.
I called my MP on the 3rd Feb 2017 to ask again if immigration can provide a better timescale now since its BEEN A WHOLE YEAR. I am now awaiting another letter from my MP from immigration on time frame.
My wife is in tears everyday now, she can not bear it anymore, she is still living with her parents in India. We got married in Oct 2015, put the application in Nov 2015, refused in Jan 2016 and appeal in Feb 2016. Since then I have gone to meet her twice, 5 weeks in Feb 2016 and 3 weeks in Oct 2016. It is really hard and heartbreaking.

My asylum case refused by the Home Office 1 year ago, which I found it totally unfair. I appealed against the Home Office decision, and the Hearing Tribunal was on October 2016. We provided all the documents required to support my appeal. I think the hearing session went well. The judge told me it will take 4 weeks for them to respond, but unfortunately it's been more that 4 months so far and I am still waiting for the court response!
Do you know what can I do to chase it up? Is it right to chase it at all? as I'm not going to disrespect them or push this issue! Should I call or write to them? Please help me as it is very very stressful situation, and I'm not sure what will happen to me..

Try not to overthink about the refusal reasons. The ECO New Delhi would have come up with one even if you had met all the requirements...
The applications shouldn't go to New Delhi embassy. There should be a office here in the UK. I would have some trust then...

Some cases are overturned just before the oral hearing. It all depends on your luck ... I've heard so many different stories and sadly the ones that are totally honest to the system end up being stuck!

My application was refused due to the financial requirement, I applied in march refused in may 2016, appealed in may. And I have been waiting, I don't know how long I will keep waiting.
In fact my spouse is earning above 23000£ annually, I have 6 months bank statement now to make a fresh application, my lawyer informed me the new immigration act 2017 is another burden as if my application is refused again I would have to leave the uk and appeal back home.

The Most frustrating part of this whole thing is my cousin is disabled, he doesnt understand how the process works, he can't do anything with his life, he's not allowed to work even voluntarily, he goes to sign on once in 4 months. He has committed a crime and has since being punished for it but the home office are even metting greater punishment on him. It is affecting his mental health, I and his mum both British citizens have to support him in living his day to day life. He has nothing to his name, his life has been on hold since 2012 and it seems as though no hope for him.. He is slowly losing it because he doesn't understand the whole thing, he has learning difficulties . He is a very good footballer, plays for both deaf and hearing teams, he's played for Birmingham Deaf and now plays for Westbrowmich deaf team. He's just been asked by the England deaf football coach if he can play for them as they need a good player like him but he can't play for them obviously. Just watching him losing opportunities because the home office wants to keep punishing him is just so sad and frustrating. Please is there anything we can do, like write to them tribunal and explain his situation maybe we get an early hearing date .

Have you ever heard of cases where Home Office decides to grant visa before the Court Date in case if they know that they can not win a particular case? My solicitor wants to send all the documents one month before the court date with a hope that Home Office may just say we can not win this one because he feels we have a very strong case.

I had my court case on the 25th of July 2016, in which case the judge told me her decision to allow my appeal right there in the court room. It's the 25th of August today and I still haven't received any written letter. Can someone please explain to me why it's taking so long. I was told the letter will get to me between 1 week or 2.

me and my husband sent sponsorship visitor visa for my husbands mother and half sister. goday they received their refusal of the visitor visa down to the grounds being said that they will not return back to their home which was very far from the truth. Seven years ago they came on a visitor visa where they were given 6month visitor visa and actual only stayed seven to eight weeks and returned straight back to their motherland. The reason for the visa was to visit and meet there children, grandchildren, daughter in laws and extended family. In seven years from the last time this have changed as our children have dramatically grew up. There haven't met our youngest childen who is six years old which they speak to regularly on the phone. The have not been given the right to appeal so how can i get a appeal in newcastle uk and represent myself . What is the legal procedure that will get the ball rolling for the appeal hearing????

I was refused on September 2015 for parent of British child , same as you please ,I have appealed on October 2015 but still waiting for a date can you share any update regarding you awaiting time, have you recieved a court date yet ?
It depends what type of application is pending with homeoffice or is there any other pending appeal may be you have thats why you want judiical review. I mean why you applied for a judicial review. If there is already a pending application with homeoffice or an appeal then you don need to worry about £320 etc. And dont need to apply for a oral hearing and just waiting for ur application.

I have filed for a divorce in Indian courts in 2014 but since then my wife has continuously denying me talks with my daughter and also changed her address. After I left the UK she made false allegation against me to Police that I have threatened her and my daughter and left for India. I have been living in UK for 14 years. Myself and my 3 years old baby applied for leave to remind in UK but our application was rejected with no appeal grated. My solicitor applied to the Home Office for removal decision which gives us right to appeal.
7 months ago I attended the tribunal but the judge said we need to submit additional papers and the case was adjourned. The documents was sent to office and the court the same week.
A day before the hearing I called the court to confirm my hearing and I was told that I am not on the list and the court said the judge will right to me to let me know when is my next hearing.
Two months after no news from the court my solicitor wrote to the court. When the court replied they said the judge will write to us to let us know the next hearing.
Its now roughly 8 months of waiting with no message from the court and the judge.

My question is, will the home office wait until the errors are corrected to see whether they will accept or go against the judge decision? Or what matter is that I won the appeal and if they would do something they would have reacted from the day of the decision which was 2 months ago?

How long does it take for Judiciary to issue a hearing date?
We made an appeal in March,the judiciary sent us a letter saying they have requested HO for a review on our case,deadline given to HO was 27th August.The deadline has passed,we havent heard any communication from either the judiciary giving us a court date for hearing or HO.
Any idea of what is happening?

About a year ago we applied for the derivative card or Zambrano application, as its most known, and the home office refused the application. We then appealed against their decision and were called to attend the first tribunal court. The judge allowed our decision. We were quite happy but after a week the home office appealed against this decision and we had to wait for the decision of the upper tribunal. The judge allowed the decision again in our favour but unfortunately after a week the home office appealed against this decision and we were called in to attend the high court. The court hearing was very short and after about two months of waiting we finally received a reply that said the judge allowed had made a decision in our favour. Now after about two weeks our lawyer called today to say that the home office has sent in a request to appeal and we have to wait what the reply will be to this. I wanted to ask what happens after this, as it seems we have won most of the courts and how forward does this go, when do the home office actually give up?
I would appreciate any answers in regards to my question.

We are not asking the government for any public funds or anything from the British tax payers. As we can finance ourself and my fiance signed a declaration for 5 years ..
So why why appeal against some one that can support themselves.
I think they should of stop visa application. Because even if you put your application right they will always find some stupid things (ex.english result ) something that I have to find on the net themselves....
And I am supris that the professional judge from the first tier tribunal decision can be overuled as they are a trained professionals....
But all I can say that they (f.... home office ) are not God and God will pay they for make people suffer for nothing. ...

It has been about 2 months since my hearing date. I was supposed to receive the decision within 10 working days. I know sometimes it takes longer and I know you do not have info about how long it will take but at least why did it take all this long? Is it because of the judge being busy or the case might be complicated?
I called them many times and the answer is always:" the decision is stillreserved by the judge"

After been refused a visa by home office with the right of appeal,we have been to the hearing appeal court and after 10 working days we had the letter from the judge saying allowed appeal..but after week we received another letter saying home office appeal against the judge decision. So I don't understand and don't know why .

Our hearing was completed on 9th June with out the home office representation. Judge advised us to wait 2 weeks before the decision letter. It's been 6 weeks now and contacted the court , judge still reserved. My visa is expiring in 3 weeks. How long the tribunal takes to give decision? Please suggest

I went to court for my appeal appointment but the home office lawyers didnt turn up. I was asked questions by my lawyer and the judge. He asked us series of queries and told us to wait for her response in 3 weeks time. I had my hearing last week against the refusal of my eu spuse visa application.we went to the court and judge ask homeoffice solicitor to present the documents but he replied that i dont have them.anyways homeoffice solicitor only asked me and my wife 1 question each and after 15mins judge finished and hearing and told us to leave the room.
Is it normal to have hearing that normal for only 15mins?? What next

secretary of state usually they don't come to the hearing day and later on the appeal against the first tribunal judge and it's make people life so stressful, would you please advice me what could be happen further
The Secretary of State believes that is in the interests of the public good that the foreign national is removed from the UK;
The foreign national is the spouse, civil partner or child of an individual who is the subject of a deportation order; or,
The foreign national is over 17 years old, has been convicted of a criminal offence which carries with it a prison sentence and the court which sentenced the foreign national recommended that he be deported once he has served his sentence.
There is a general presumption that a deportation order is in the interests of the public good and that this consideration will outweigh all over factors – unless deportation would breach the individual’s human rights or his rights under the European refugees convention. Once a deportation order has been made against, and served on, a foreign national he may be held in detention without any further warning. Alternatively, other restrictions may be placed on his activities while he remains in the UK. When the foreign national is given notice of the deportation order he will also be notified of his rights of appeal. I hope this helps.

Please can some one help me my partner was sentenced to 6 months imprisonment and his sentence ended on the 5th of december 2014. We have been to court due to his immigration case we went to court for the final hearing 19th of december 2014 and havent heard anything back since they say we were ament to get a decision 2 weeks after the court date but still havent heard anything bail was not granted could any body tell me what to do next or what this means .

I appealed on November 2014 and it only took about 2 months when they sent to my solicitor a letter saying that my hearing is going to be on June 2015. You will definitely need to contact your solicitor if you have one. All the best

However do they applied the 10year spent sentence rule on him which was incorrect it is the 5year spent sentence. Got paper work from the tribunal the Eco has upheld their decision b has agreed that they applied the wrong law to him and in fact he does fall into the 5year spent sentence which is to finish this year March 2015. I have an acute physical condition I supplied medical letters etc, the Eco said that I have enough help support from family and nhs she sees no reason as to why I would need my husbands. And lastly I cited article 8 right to family life , is my basic human right. The Eco stated that she cannot see any family life between me and my husband.
I have been given an appeal hearing date for May by then his spent sentence would be done...any ideas what to expect and what I can do to help my case?
Doc and consultant and therapist will be giving me supported letters and family, husband will be getting charge to reference from work and people of standing in his community.

My spouse visa was refused because we didn't show full year financial requirements. We applied for the appeal and the hearing is on end of February. Now we have all the documents required to show on the day of the hearing. We didn't show them before because we don't have experience and we thought six months were enough. Hopefully they will accept to give me the visa. But in case tgey don't do I still have the right to do another application from the UK or they will tell me to go back to my country and apply from their?

Give the proof they want so I had my solicitor to help me the reason of refusal was of 1 pay slip and a letter from my work place stating my anual sallery. The Immigration and Asylum First Tier Tribunal will send the Respondent a Rule 13 letter as a reminder to file their documents, however this will not delay the hearing notice.
Please, what does rule 13 letter mean? What happens if the respondent do not respond? I need someone to please clarify this.
I did phone HMCourts & Tribunals service and reason was. Judge couldn't take decision that day for my case.
It was straight forward case.
We made sure that our case was well prepared as we waited so long for the hearing and didn't want to get refused again.
And our barrister made sure that everything was ok.

her visa was refused on 12/2013 reason for,I did not send letter from my employee. And they need it more proof that our marriage was genuine.
We made an appeal on 15/01/2014
Waited for our application to be reviewed.till 26/06/2013.
It never happend.
And I recived a letter for a court hearing for 11/11/2014.
We made sure that everything was ok as we waited for so long and didn't want to get refused again.
And we also have a emmigration barrister wich helped a lot with the paperwork.
On 10/11/2014 I had an email from my barrister stating that the hearing is been adjourned.
And I hade a letter from HM Courts & tribunal service new hearing date.
Wich is on 13/05/2015 exactly 6 months.
Can anyone advise me on my situation here?

I appealed against the decision through a solicitor, after which we received a letter from the Tribunal stating they will write to my solicitor after the 5th of November. We haven't been to court, I don't even know when we would be heading for the court but we haven't heard from the Tribunal or the Home Office.
I am suspecting my solicitor doesn't know much about the UK Nationality law.
With what I posted yesterday, I was trying to know what the tribunal meant by the statement. The Home Office is the Respondent "The Tribunal directs the Respondent to file by 5 November, 2014 a copy of the notice of decision to which the notice of appeal relates, and any other document giving reasons for that decision, together with any application form, record of interview, or any other documents on which you rely. You must serve, on the appellant, a copy of all documents, except for documents which you have already sent to the appellant."
I just want to clarify, if there is any breach in the law as the time given to the Respondent (Home Office) has lapsed and we are yet to know from neither the Tribunal nor the Home Office... Just want to know my next line of action.

i need your advice.i gave notice for marry in 2AUG.2014 and we fixed our date of marriage by 9Aug.2014 but when we heard of my partner sister was sick and he was obliged to go see her for 10 days ,then we cancelled our marriage date but im student tier4 and my partner from east europe. my visa expired date was in 17Aug.2014 ,i sent my application before 2 days to home office after 10 days i recieved letter for biomatrice but i still didnt send all my documentsbecause my college was revoked and i was waiting for my diploma and after it was late to get admission in any college or uni because they are already started , so do you advice me to register for marriage soon or i will face a problem?
i applied the visa on 2 sept 2014....but the college cas letter expired on 15 sept 2014.
i get a call from high commission telling your cas letter is expired,so they demanding if you any email or any other document like to prove that college have no problem.....soooo
i contacted to college they send me the new cas letter but date of 27 november 2014 is new starting date of course (block 2)...

Provided with application on 19/6/2014 was DLA award notice till 12/4/2014 then letter from DWP saying DLA had been extended until personal independance allowance would be awarded and bank statements were provided to prove payments of DLA were still active at the time of application.
Uk visa in Paris failed to take note of the extension letter and bank statements, they refused the visa saying DLA was only paid up until 12/4/2014.
Dnt be nervous be strong show them that you want to stay with your family!! Show then that you want to work ! Be positive , after how long did you had to wait for your appeal?

I am in uk since 29th july 2005. Almost 9years. I applyed further extention as student but ukvi has refused that and given appeal permission. I have appealed under 1st tier tribunal on 30th of june 2014. I am waiting for hearing date. May this case can continue next 8 to 10 months. If i loose the case will go to upper tribunal to court. If i win after 12 months well and good so i can apply for FLR. But aftet 12 months if i do not win can i apply for FLR?
